ORDINANCE NO. 16,616
AN ORDINANCE VACATING PUBLIC UTITILY AND DRAINAGE
EASEMENTS IN MONTCLAIR HEIGHTS SUBDIVISION (PART II),
CITY OF LITTLE ROCK, ARKANSAS PURSUANT TO THE ARKANSAS
CODE ANNOTATED SECTION 14 -54 -104 (MICHIE 1987)
WHEREAS, a petition was duly filed with the Board of
Directors of the City of Little Rock, Arkansas on the
10th day of February 1994, asking the Board of Directors
to vacate portions of the public utility and drainage
easements designated on the plat of Montclair Heights
Subdivision (Part II), City of Little Rock, Arkansas, now
appearing of record in Plat Book 6, Page 25, and in Book
Book 745, Page 471, in the office of the Recorder of Pulaski
County, Arkansas.
WHEREAS, after due notice as required by law, the Board
has, at the time and place mentioned in the notice, heard
all persons desiring to be heard on the question and has
ascertained that the easements, or portions thereof,
hereinbefore described, has heretofore been dedicated to the
public use as utility and drainage easements herein
described; that all the owners of the property abutting upon
the portion of the utility and drainage easements to be
vacated have filed with the Board their written consent to
this action; and that public interest and welfare will not
be adversely affected by the vacating of the utility and
drainage easements.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, pursuant
to the authority of Arkansas Code Annotated Section 14 -54-
104 (Michie 1987), hereby releases vacates and abandons all
its rights, together with the rights of the public
generally, in and to the utitily and drainage easements
designated as follows:
All those easements in Montclair Heights Subdivision
(Part II) lying North of Chenal Parkway and that part of
Alamo Circle closed by Ordinance No. 16,113 and retained
as utility easement.
SECTION 2. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the Office of the Recorder
of Pulaski County and recorded in the records of the County.

SECTION 3. This Ordinance shall take effect and be in
force from and after its passage and approval.
