HomeMy WebLinkAbout16608153 ORDINANCE NO. 16,608 AN ORDINANCE VACATING A PUBLIC UTITILY EASEMENT IN RIVERDALE ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas on the 27th day of January , 1994, asking the Board of Directors to vacate a public utility easement designated on the plat of Tract D -2A Replat, Riverdale Addition to the City of Little Rock, Arkansas, now appearing of record in Plat Book A, Page 317, in the office of the Recorder of Pulaski County, Arkansas. WHEREAS, after due notice as required by law, the Board has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the easement, or portions thereof, hereinbefore described, has heretofore been dedicated to the public use as a utility easement herein described; that all the owners of the property abutting upon the portion of the utility easement to be vacated have filed with the Board their written consent to this action; and that public interest and welfare will not be adversely affected by the vacating of the utility easement. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, releases vacates and abandons all its rights, together with the rights of the public generally, in and to the utitily easement designated as follows: A 10' easement lying North of and being parallel with and adjacent to the South line of Tract D-2A Replat, Riverdale Addition, Little Rock, Pulaski County, Arkansas, as recorded in Plat Book A, page 317. SECTION 2. A copy of this the City Clerk, shall be filed of Pulaski County and recorded Ordinance, duly certified by in the Office of the Recorder in the records of the County. SECTION 3. This Ordinance shall take effect and be in force from and after its passage and approval.
