HomeMy WebLinkAbout16607150 ORDINANCE NO_ 16,607 AN ORDINANCE VACATING AND CLOSING PORTIONS OF CEDAR HILL ROAD AND ALLIED DRIVE IN RIVERDALE ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS WHEREAS, it has been determined that portions of Cedar Hill Road and Allied Drive in Riverdale, Addition to the City of Little Rock, Arkansas, as designated on the plats of said subdivision now appearing of record in Plat Book 33, Page 34 and Plat Book B, Page 284 in the Office of the Recorder of Pulaski County, Arkansas, is no longer needed for corporate purposes. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Except as stated in Section 2 below, the City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally in and to the street designated as follows: All of the Allied Drive right -of -way lying North and East of Riverfront Drive as recorded in Plat B, page 284. =i. All that portion of Cedar Hill Road as recorded in Plat Book 34, page 33, lying North and East of Riverfront Drive. SECTION 2. The City of Little Rock specifically retains the right to use, and allow others to use, portions of the former street right -of -ways as follows: 1) The entire area of Cedar Hill Road will be reserved as public utility and drainage easement 2) The Western 100 feet of Cedar Hill will be reserved as a public access easement for maintenance of public facilities 3) The Northern 10 feet of Allied Drive will be reserved as an easement for the exclusive use of Southwestern Bell Telephone. SECTION 3. Abutting owners of record, receiving title to the abandoned right -of -way and easement shall at their cost remove all vestiges of public use and access as may exist; such modifications shall include, but are not limited to the following: A. The entrances on both ends of the abandoned right - of -way and easement shall be offset and /or rebuilt to conform to the standard driveway design as required by Ordinance No. 12,501. rmB)all -r -w O'7Z • • B. The edge of pavement of the right -of -way shall be rebuilt to conform to existing conditions in the general vicinity where the abandoned right -of -way and easement intersects with the remaining public right -of -way. SECTION 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County and recorded in the records of the County. SECTION 4. This Ordinance shall take effect and be in force from and after its passage and approval.
