4 AN ORDINANCE AMENDING CHAPTER 1 OF
5 THE LITTLE ROCK CODE OF ORDINANCES
6 TO PROVIDE FOR SEVERABILITY OF CODE
7 PROVISIONS TO THE EXTENT OF
8 CONFLICTS BETWEEN CITY ORDINANCES
9 AND STATE OR FEDERAL LAW, AND FOR
10 OTHER PURPOSES.

12 WHEREAS, the Supremacy Clause in the United States
13 Constitution, Article 6, S 2 states that when federal laws
14 conflict with state laws, federal laws will govern; and
15 WHEREAS, Ark. Code Ann. S 14 -43 -601 delineates municipal
16 affairs for cities in the State of Arkansas, and also delineates
17 state affairs subject to the general laws of the State of
18 Arkansas; and
19 WHEREAS, language should be added to the Little Rock Code
20 of Ordinances to provide for severability of provisions that
21 conflict with state or federal law.
22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
23 THE CITY OF LITTLE ROCK, ARKANSAS:
24 SECTION 1. Chapter 1, section 1 -8 is hereby deleted in its
25 entirety and the following language is to be substituted
26 therefor:
27 SECTION 1 -8. Severability of parts of Code.
28 It is hereby declared to be the intention of the board of
29 directors that the sections, paragraphs, sentences, clauses and
30 phrases of this code are severable.
31 (a) In the event that any phrase, clause,
32 sentence, paragraph, or section of this Code
33 shall be declared unconstitutional by the
34 valid judgment or decree of a court of
35 competent jurisdiction, such
36 unconstitutionality shall not affect any of

the remaining phrases, clauses, sentences, 149
paragraphs and sections of this Code.
SECTION '2. REPEALER.: That all ordinances and parts
thereof in conflict herewith are hereby repealed to the extent
of such conflict.
