DIVISION OF THE LITTLE ROCK
MUNICIPAL COURT AS AUTHORIZED BY
ACT 39 OF 1992; DECLARING AN
EMERGENCY; AND FOR OTHER PURPOSES.

WHEREAS, Act 39 of 1992, Acts of Arkansas, codified as Ark.
Code Ann. § 16- 17- 108(ccc) and § 16- 17- 119(c), authorized the
creation of a Third Division of the Little Rock Municipal Court;
and
WHEREAS, this Board recognizes the immediate need for a
Third Division of the Little Rock Municipal Court for the
following reasons: (1) the case load in the existing divisions
have increased by more than twenty percent in the last two years,
and is expected to continue to increase; (2) the increased work
load of the existing divisions results in overtime costs and lost
manpower while on -duty personnel are in court, including police
officers, fire department personnel, and code enforcement
personnel; (3) there has been an increase in the work load of the
existing Judges and their respective staffs.
WHEREAS, the Special Election on December 14, 1993,
adopting Little Rock, Ark., Ordinances 16496 and 16515, reflected
a desire by the people of Little Rock to have an aggressive
enforcement of those ordinances designed to improve the quality of
life in all our neighborhoods throughout the City, including the
ordinances governing enforcement of the housing codes, animal
control codes, zoning and subdivision regulations, signs, weed
lots, trash, and nuisances in general; and
WHEREAS, additional implementation and enforcement of a

comprehensive rental inspection program will increase the

Municipal Court case load.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF

THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1. The Third Division of the Little Rock Municipal
6
Court is hereby created as authorized by Act 39 of 1992, Acts of
7
Arkansas.

SECTION 2. The.annual salary of the Judge shall comply with
9

Ark. Code Ann. § 16- 17- 108(ccc), as amended. The salaries of the
11
Court staff will be subject to those laws providing for the
12
salaries of administrators, clerks, probation officers, and other
13
municipal employees. Said employees shall be subject to City
14
employment policies.

SECTION 3. The Judge of the Third Division shall appoint a
16
17
sufficient number of administrators, clerks, probation officers
18
and other employees for the proper functioning of the Court. Said
19
employees shall perform the same duties as provided for by general
20
law for other employees similarly situated. The Judges of all
. 21
three divisions are hereby empowered by agreement to generally
22
divide the duties among their individual court reporters,
23
administrators, probation officers, and clerks on an equal and
24
25
fair basis as they may determine to be in the best interest of the
26
operation of all divisions to reduce duplicative services.

SECTION 4. It is the primary responsibility of the Third
28
Division to assume jurisdiction of alleged violations of the
29
Little Rock City Code, as revised. Provided, however, that the
30

First, Second, and Third Divisions may, by agreement, divide the
32
assignment of any and all cases filed in Little Rock Municipal
33
Court, as authorized by State law.

SECTION 5. Venue and jurisdiction of the Third Division of
35
the Little Rock Municipal Court shall be as permitted by law.

SECTION 6. Emergency Clause. The Board of Directors hereby
determines that there is an immediate and urgent need to implement
the City's rental inspection program, and that creation of the
Third Division of the Little Rock Municipal Court is necessary for
the program to be carried out as intended; and there is an
immediate need to assist existing divisions of the Little Rock
Municipal Court to effectively carry out the needs of the judicial
system. Therefore, an emergency is hereby declared to exist, and
this Ordinance being immediately necessary for the preservation of
the public welfare, peace, health and safety, shall take effect
and be in force from and after the date of its passage.
