HomeMy WebLinkAbout166001 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 125 ORDINANCE NO. 16,600 AN ORDINANCE AMENDING CHAPTER 17, ARTICLE II OF THE LITTLE ROCK CITY CODE, 1988, PERTAINING TO LICENSE AND PRIVILEGE TAXES; TO REGULATE THE OPERATION OF FOOD SERVICE ESTABLISHMENTS; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS, food service establishments are required to procure a State permit from the Division of Sanitarian Services of the Department of Health under Ark. Code Ann. § 20 -57 -204; and WHEREAS, the City is permitted to regulate engaging of food service establishments under Ark. Code Ann. § 26 -77 -105; and WHEREAS, there is a potential threat to the health, safety and welfare of the citizens of the City of Little Rock if food service establishments are not properly licensed and displayed. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Chapter 17, Article II of the Little Rock City Code, 1988 is hereby amended as follows: Section 17 -53. All persons, firms, individuals, or corporations required to obtain a State Food Establishment Permit from the Division of Sanitarian Services of the Department of Health under Ark. Code Ann. § 20 -57 -204 shall prominently display said permit or an exact facsimile thereof at each address or location of operation. Section 17 -54. To verify appropriate licensure, the receipt for all food deliveries by entities required under this ordinance to have a privilege license shall reflects the State Department of Health permit number. �■ w �■ w w ■� w w w w w w w w w 126 Section 7 -55. Each food establishm nt address 1 or location of operation shall maintain a 2 current address of each such location and the 3 name of the manager of each location with the 4 City Collector. 5 Section 17 -56. Each food establishment address 6 and kitchen location shall obtain and 7 prominently display a City privilege license 8 or an exact facsimile thereof. 9 Section 17 -57. All nonprofit food service 10 establishments now or hereafter required to 11 obtain a State Department of Health food 12 establishment permit shall also be required to 13 obtain a City privilege license. The required 14 state permit must be presented to the city 15 collector before the privilege license can be 16 issued. The fee for the privilege license 17 shall be waived. 18 Section 17 -58. The revocation of the State 19 Department of Health food establishment permit 20 shall constitute automatic revocation of the 21 City privilege license. The privilege license 22 shall be reinstated only if the State 23 Department of Health permit is reissued. 24 Section 17 -59. Failure to present a State Food 25 Establishment Permit or a City privilege 26 license when requested by a City Code 27 enforcement officer upon request each shall be 28 deemed a violation by the owner and manager 29 and shall be punished as provided in Section 30 1 -9. In addition thereto, failure to present a 31 State Food Establishment Permit or a City 32 privilege license when requested by a City 33 code enforcement officer upon request shall be 34 deemed a failure to be properly licensed as a 35 food service establishment. Under those 36 circumstances, the City code enforcement 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 officer is hereby granted the authority to 127 seize all food at such food establishment address or kitchen location of operation until such time as the proper State Food Establishment Permit and City privilege license has been produced for that location. SECTION 2: All businesses subject to this ordinance that have a valid privilege license on the effective date of this ordinance shall provide proof of a valid State Food Establishment Permit when applying for a 1995 privilege license. All businesses that do not have a valid privilege license on the effective date of this ordinance shall provide proof of a valid State Food Establishment Permit at the time the business applies for a privilege license. SECTION 3. EMERGENCY. The service of food to the general public presents enormous potential risks to the health, safety and welfare of the general public if not properly regulated. In order to reduce the potential for such risks it is essential that this regulation be adopted at the earliest time possible. An emergency is therefore declared to exist and this ordinance shall be in full force and effect from and after the date of its adoption.
