HomeMy WebLinkAbout15933ORD -A -1 ORDINANCE NO. 15,933 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF KANIS ROAD REMAINING AFTER THE NEW ALIGNMENT OF CHENAL PARKWAY IN THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, it has been determined that a portion of Kanis Road in the City of Little Rock, Arkansas, is no longer needed for corporate purposes except for public utility and drainage purposes. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its right, together with the rights of the public in and to the street right -of -way designated as follows: All that portion of Kanis Road lying between the southeasterly right -of -way line of Chenal Parkway and the southwesterly right -of -way line of the new right -of -way line of Kanis Road as recorded in Instrument No. 88- 65303. SECTION 2. The City specifically retains the right to use, and allow others to use the former street right -of -way in its entirety as a public utility and drainage easement. SECTION 2. Abutting owners of record receiving title to the abandoned right -of -way shall at their cost remove all vestiges of public use as necessary. SECTION 4. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County and recorded in the records of the County. SECTION 5. FOR A VALUABLE CONSIDERATION, the receipt and sufficiency of which is hereby acknowledged "Lasley" and "Shackleford" both warrant that they are the owners of land adjoining that portion of Kanis Road lying between the southeasterly right -of -way line of Chenal Parkwav and the southwesterly right -of -way line of the new rLghc -sf- way line of Kanis Road. Said land is the subject of a fatition For Abandonment of a public street which said Petition is included to the AGENDA to be heard by the City of Little Rock Planning 'lonmise.i"u during a meeting on Tuesday, August 14th, 1990 at 1 PM. Both parties further agree that the Little Rock Staff has recommended approval of the riglit -of -way abandonment as filed, subject to resolv- ing the Questions of access to the adjacent property owners rent hostess on the southland reversionary rights. In view of the fact that such abandonment would eliminate access to "Shackleford's" property and several rent houses on said property, it is necessary that "Shackleford" obtain an easement for road pur- poses over a small portion of the abandoned street which will revert Co "Lasley" if such abandonment is approved. The engineers legal description will not be available in time to prepare the legal document creating the easement{ however, in con- sideration of "Shackleford" agreeing to such abandonment "Lasley" agrees to execute all documents to create the easement when the legal description is available (which shall be prior to the next meeting of the City Board of Directors where the Petition for Abandonment will be considered). Both parties agree chat each will receive the customary one -half of the abandoned street which joins their property and "Lasley" further .agrees that he will not disturb in any manner that portion of Kanis Road described in the Petition for Abandonment for a period of three years from the date of this agreement.
