OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, PROVIDING FOR DEFINITION, MODIFICATION AND PROCEDURAL REVISIONS. WHEREAS, the City of Little Rock is in need of maintaining accurate parcel and related information; and WHEREAS, a Geographic Information System (PAGIS) is designed to fill this need; and and `52 WHEREAS, accurate surveying and plat information is essential; WHEREAS, surveys completed over the last several years fail to meet necessary and desired levels of accuracy; and WHEREAS, the Subdivision Regulations are the appropriate instrument for achieving this accuracy; and WHEREAS, the technical staff of PAGIS recommends improving the accuracy of subdivision plats to maintain the accuracy of the overall system; and WHEREAS, City staff and related professionals have reviewed the proposals for appropriateness. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Chapter 31. of the Code of Ordinances be amended as follows: Subsection a. That Chapter 31., Article I., Section 31 -2 be amended to provide the inclusion of the following definitions: PAGIS means Pulaski Area Geographic Information System, a computerized geographic information system developed and maintained by the City of Little Rock, Little Rock Municipal Water Works and Little Rock Wastewater Utility. Principle Subdivision Boundary means the property boundary; (edge) of the total ownership being the approved preliminary plat boundary.. D -45 1 c -9 M PAGIS Monument means a cast in place or prefabricated monument which shall consist of similar construction describe as: a six -inch diameter steel reinforced concrete post with a stamped survey cap (see section 31 -380). Subsection b. That Chapter 31, Article II., Division 1., Section 31- 36.(3) be amended to provide for the modification of sentence four for the purpose of providing the Clerk with sole authority for the filing of plats and reads as follows: 3. The third step involves submittal of a final plat conforming to the preliminary plat. This step shall be initiated not later than twelve (12) months after approval of the preliminary plat by the planning commission unless construction work is actively progressing, in which case the preliminary approval remains valid. The final plat is a completed document incorporating engineering specifications in a form, required for legal record and sale of lots. No subdivision plat or any part thereof shall be recorded prior to obtaining final plat approval from the Neighborhood Revitalization and Planning Department, nor shall the subdivider convey title to any lot or lots before obtaining final plat approval and recording of the final plat by the City. Subsection c. That Chapter 31., Article II., Division 3., Section 31- 89.(1) be amended to provide for additional vertical information on preliminary plats and read as follows: 1. Contours shown at intervals of not more than five (5) feet for terrain with an average slope exceeding ten percent (10 %) or more, and at an interval of two (2) feet for terrain with slopes less than ten percent (10 %). The source of the contours along with the source from which all elevations were derived shall be clearly described. Subsection d. That Chapter 31., Article II., Division 3., section 31- 89.(14) be amended to provide for the requirement of additional boundary survey information on the preliminary plat and read as follows: 14. Boundary survey information of the tract shall be as follows: a) Boundary lines shall be indicated by a heavy line. M b) Adjusted bearings and distances shall be shown on all boundary lines and ties to all corners of record utilized. Where boundary lines are curves, sufficient curve data shall be provided to adequately describe said curve. As a minimum, curve data for each curve shall consist of radius, arc distance, delta angle and chord bearing and distance. Where boundary lines are common with previously platted properties, record bearings and distances shall also be shown. C) Accurate locations and adequate physical descriptions of all monuments shall be shown indicating size, type of material and construction thereof. d) Metes and bounds legal description of the tract boundary. Subsection e. That Chapter 31., Article II., Division 3., Section 31,89, be amended to add a provision that plats be duly filed in the State Surveyor and County Court House within the last seven years. 17) Certifications that the plat has been surveyed and duly filed for record in the offices of the State Surveyor and the Pulaski County Circuit Clerk /Recorder within the last seven (7) years. Subsection f. That Chapter 31., Article II., Division 3., Section 31 -89, be amended to add a provision for phasing and monumentation of the subdivision. 18) A phasing plan outlining the boundaries for each phase and the location of all PAGIS monuments for the subdivision. PAGIS monuments shall be placed such that each corner of the principle subdivision boundary has a PAGIS monument and any phase shall have at least two (2) PAGIS monuments. 0 0 Subsection Q. That Chapter 31., Article II., Division 3., Section 31 -91., Certificate of Preliminary Plat Accuracy be amended to state that the subdivision rules and regulations and the Arkansas Plat Law have been complied with. CERTIFICATE OF PRELIMINARY SURVEYING ACCURACY I, , hereby certify that this plat correctly represents a boundary survey made or verified by me that all surveying requirements of the State of Arkansas and City of Little Rock Subdivision Rules and Regulations have been complied with and a copy of said boundary has been duly filed for record in the offices of the State Surveyor and the Pulaski County Circuit Clerk on 19 , in Plat Book Page Date of Execution Name Registered Professional Land Surveyor No. Arkansas 355 Subsection h. That Chapter 31., Article II., Division 4., Section 31- 117.,(a) be amended to provide that a reproducible copy of the final plat be supplied to the City and to establish a time frame for the Clerk to file plats after approval and read as follows: a. Submission for certification of final plat approval shall consist of the document and two (2) transparent originals (one (1) shall be a mylar), plus fifteen (15) copies showing all certificates as specified in Section 31 -118, with the certificate of owner, Certificate of Engineering Accuracy and Certificate of Surveying Accuracy being executed. The final plat shall be clearly and legibly drawn in black ink on suitable tracing material at the same scale and dimensions used for the approved preliminary plat. Upon approval and execution of the Certificate of Final Plat Approval, the Owner's representative will file the plat for record at Circuit Clerk's Office and return a certified mylar to the City within two (2) working days, unless mutually agreed to by the owner's agent and City representative. 4 0 0 Subsection i. That Chapter 31., Article II., Division 4, Section 31- 117.(b) be amended to provide that sufficient survey information be provided to support the input of the plat into the PAGIS system. Items 5 and 6 shall be combined into Item 5 with a serial restructuring of Items 1 through 18 accordingly to read as follows: b. The final plat shall indicate the following information: 1. Name and address of owner of record and subdivider. 2. Name of subdivision. 3. Date of the plat, north point and graphic scale. 4. Names of all streets. 5. Boundary information of the tract shall be as follows: a) Boundary lines shall be indicated by a heavy line. 3156 b) Adjusted Arkansas State Plane Coordinates (North Zone, NAD -83) shall be shown for all boundary corners and all corners of record utilized, along with a statement indicating the ratio error of closure of the field work. C) Adjusted bearings and distances shall be shown on all boundary lines and ties to all corners of record utilized. Where boundary lines are curves, sufficient curve data shall be provided to establish or re- establish said curve. As a minimum, curve data for each curve shall consist of radius, arc distance, delta angle and chord bearing and distance. Where boundary lines are common with previously platted properties, record bearings and distances shall also be shown. d) Accurate locations and adequate physical descriptions of all monuments shall be shown indicating size, type of material and construction thereof, and size and type of survey disk utilized. Where found monuments are replaced with more permanent monuments, such replacement shall be noted and a description of the type of found monument indicated. 5 • • 357 6. Streets and alleys within and abutting the subdivision, with street names indicated and showing the source of dedication. 7. Street Center line shall be shown with the following information provided: a) Bearings and distances along all line segments. b) Angles of intersection. C) Curve data for all curves indicating the following: 1. Radius 2. Length of tangents 3. Delta Angle 4. Chord Bearing and Distance Sufficient geometric data shall be provided along all rights -of -way to produce a closed polygon figure within the bounds of the tract being platted. S. Source of title giving deed record book and page number or instrument number. 9. Sufficient geometric data shall be provided along all lot lines (bearings and distances and /or angles) to produce a closed polygon figure for each lot, with chord bearings and distances and radii of rounded corners. lo. Building setback lines with dimensions. 11. Lot and block numbers. 12. Easement, buffer strips and public service utility right -of -way lines giving dimensions, locations and purpose. 13. Sufficient geometric data shall be provided to produce a closed polygon figure along with a description of any areas to be dedicated or reserved for public use or acquisition with the purpose indicated thereon; and of any areas to be reserved by deed covenant for common use of all property owners. 14. Accurate locations and descriptions of all monuments. 15. Key map where more than one (1) sheet is required to present map. 25 • • 16. Location of tract by metes and bounds legal description giving acreage to the nearest one thousandth of an acre. 17. Any area or lot which may be prone to local flooding shall have the lowest allowable finished floor elevation indicated on the final plat. This elevation shall be compared to the one- in -one- hundred -year flood elevation shown on the flood insurance study or, if not available, any other applicable study in which the one-in- one - hundred- year flood elevation is depicted. The Engineering Division shall review an approved compliance with Chapter 8, Article IV. Subsection i. That Chapter 31., Article II., Division 4., Section 31- 117.,(c) be amended to include submittal of all survey calculations and field notes upon request when errors or noncompliance to the regulations are suspected on the final plat and read as follows: C. Copies of all survey calculations and field notes shall be submitted for review when requested. When errors are suspected, the Planning Commission may cause a surveyor to check the final plat for correctness. Certification of approval of water supply and sanitary sewage disposal by the appropriate agency, when not connected to the municipal system, shall be submitted. Subsection k. That Chapter 31., Article II., Division 4., Section 31 -117, be amended to include requirements for monumentation of final plats. d. All PAGIS monuments shown on the approved preliminary plat for the phase being final platted shall be monumented. Subsection 1. That Chapter 31., Article II., Division 4., Section 31 -118., Certificate of Surveyor Accuracy be amended to certify that all required monumentation has been completed and all surveying requirements have been complied with at time of submittal of plat for approval and read as follows: 7 CERTIFICATE OF SURVEYING ACCURACY I, , hereby certify that this plat correctly represents a boundary survey made or verified by me, all monuments required actually exist and are correctly shown hereon and that all surveying requirements of the Little Rock Subdivision Rules and Regulations have been complied with. That Chapter 31., Article II., Division 4., Section 31- 121.,(b) be amended to include the review for compliance with survey requirements into the final plat approval process and read as follows: b. Review of Final Plat. The Engineering Division shall review final plats for conformance with drainage and /or construction plans approved in conjunction with the preliminary plat and for conformance with the survey requirements within this chapter. Comments will be forwarded to the Planning Department for use in final plat review. Subsection n. That Chapter 31, Article II., Division 4., Section 31- 121.,(c) be amended to include the provision that the survey requirements be verified before approval of final plat and read as follows: C. Approval. Responsibility for final plat approval shall reside with the Planning Director, who shall approve or disapprove the final plat within thirty (30) days of the submission thereof, unless the Subdivider agrees in writing to deferral. Within fifteen (15) days of the submittal of the final plat, the Planning Director, or designee, shall notify the applicant of the status of his plat. No final plat shall be approved until its conformance with the preliminary plat and the survey requirements within this chapter has been verified and the subdivider and the City have entered into an Agreement assuring completion of all required improvements as specified in Section 31 -431. Approval of the final plat shall be accomplished when the Planning Director signs the certificate of final plat approval as shown in -this division. • • goo Subsection o. That Chapter 31., Article I., Section 31 -2. be amended to provide for the definition of PAGIS Geodetic Control Network and read as follows: PAGIS Geodetic Control Network means a group of survey monuments dispersed within the planning jurisdiction of the City for which horizontal and /or vertical positions have been determined and which have been approved by the City for use as ground control for surveying and engineering projects within the planning jurisdiction of the City. Subsection P. That Chapter 31.,'Article III. be amended to add Division 9. Minimum Survey Standards and read as follows: DIVISION 9. MINIMUM SURVEY STANDARDS Section 31 -377. Generally This division is provided to establish minimum standards for surveying work performed for the development of subdivisions within the jurisdiction of the Little Rock Planning Commission. This division shall apply to all developments requiring the submittal of a preliminary and /or final plat to the Planning Commission for review and approval. All boundary surveys performed for the purpose of subdividing properties within the jurisdiction of the City shall conform to the "Arkansas Minimum Standards for Property Boundary Surveys and Plats" except where the standards contained within this chapter exceed those established by the State. Section 31 -378. Horizontal Control Standards a) The horizontal datum for all survey work performed shall be the Arkansas State Plane Coordinate System - North Zone - NAD -83 Adjustment. All horizontal control work shall commence and end at a PAGIS geodetic control network monument or other approved monument. b) Horizontal positions for all subdivision boundary corners shall be determined to an accuracy standard equal to Second Order, Class II classification as defined by the Federal Geodetic Control Committee. All field techniques and procedures shall be compatible with the equipment utilized to insure that a true Second Order, Class II accuracy level is achieved. C) A minimum of two (2) subdivision boundary corners shall be tied into a PAGIS geodetic control monument by closed traverse. The two (2) corners shall be intervisible with each other. Position and reference information shall be provided on a standard form for each corner and submitted with the final plat. Forms may be obtained from the • 0 Planning Department. These monuments will be included into the PAGIS Geodetic Control Network if, after their review by the Engineering Staff, they are determined to be suitable for inclusion into the network. d) All interior corners of the subdivision (lot corners, street center line control points, etc...) shall be established and monumented to meet the minimum accuracy standards established by the Arkansas Minimum Standards for Property Boundary Surveys and Plats for Urban, Type A property. Section 31 -379. Vertical Control Standards a) The vertical datum for all survey work performed shall be the National Geodetic Vertical Datum 1929 Adjustment (NGVD29). All vertical control work shall commence and end at PAGIS geodetic control monument or other approved monument. b) Elevations for all concrete monuments shall be determined to an accuracy standard equal to Third Order classification as defined by the Federal Geodetic Control Committee. All field techniques and procedures shall be compatible with the equipment utilized to insure that a true Third Order accuracy level is achieved. C) Elevations shall be determined for all subdivision boundary corners. Section 31 -380. Monumentation a) All principle subdivision boundary corners shall have PAGIS monuments with at least two monuments per phase as approved on the preliminary plat. These monuments may be cast in place or prefabricated and shall be of a similar construction described as follows: 1. Six -inch diameter steel reinforced concrete post set flush with ground. 2. Monument shall be a minimum of thirty (30) inches in depth. 3. Steel reinforcement shall consist of a minimum of two (2) 34 -inch long 1/2 -inch diameter steel bars. Bars shall be driven a minimum of 6- inches into undisturbed soil. 4. A brass or aluminum survey cap, a minimum of 2- inches in diameter, shall be cast or grouted into the top of the concrete post. 10 362 The following information shall be stamped into the survey cap. a) A stamped "X" or 11.11 to mark the precise location of point being monumented. b) Registration No. of the Surveyor in charge. b) All lot corners and boundary corners other than those described in paragraph (a), above, shall be monumented according to the specifications outlined with the "Arkansas Minimum Standards -for Property Surveys and Plats" and any amendment made thereto. C) All street center line intersections and beginning and ending points of curves shall be monumented and shall be of a similar construction described as a 112 -inch or larger diameter steel rebar, a minimum of 24- inches in length. The highest point shall be at least 1/2 -inch below the surface of the asphalt roadway. For concrete roads, said monuments shall be flush with the finished roadway. Test bore hole may be used to set pin. Subsection 4. That Chapter 31., Article IV., Division 1., Section 31 -405 be amended to combine items (a) and (b) and utilize a reference to Section 31 -380 defining monumentation and read as follows: All permanent boundary, lot and street center line control monuments shall be set in accordance with Section 31 -380 of this chapter and shall be indicated on all plats. Removal of any monument by anyone not under the direct supervision of a Registered Land Surveyor registered under the Laws of the State of Arkansas is prohibited.
