HomeMy WebLinkAbout19160I 2 ORDINANCE NO. 19,160 3 AN ORDINANCE TO AMEND A CONTRACT WITH JOYNER, FORD & 4 BURKE CONSTRUCTION COMPANY FOR STREETSCAPE WORK; TO 5 DISPENSE WITH ANY REQUIREMENT FOR COMPETITIVE BIDDING; 6 TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. 7 8 WHEREAS, after a competitive bidding process the City awarded a contract to Joyner, Ford 9 & Burke to complete streetscape and other work for the Riverfront Park pursuant to Little Rock, 10 Ark., Resolution No. 11,771 (June 15, 2004), and 11 WHEREAS, it has been determined that additional work adjacent to the area of this contract 12 in an amount not to exceed seventy -five thousand dollars ($75,000.00) needs to be done and 13 should be completed within the same time frame as the earlier agreement, and 14 WHEREAS, Joyner, Ford & Burke agrees to complete this additional work within the same 15 time frame as the original contract or be subject to the liquidated damages provision of the 16 contract, 17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE 18 CITY OF LITTLE ROCK, ARKANSAS: 19 Section 1. The City Manager is authorized to amend a contract with Joyner, Ford & 20 Burke entered into pursuant to Little Rock, Ark., Resolution No. 11,771 (June 15, 2004), to 21 complete additional streetscape improvements in the River Market area provided that this 22 additional work shall be subject to the terms and conditions of the original contract. 23 Section 2. Because this additional work needs to be completed at the same time as the 24 work required in the first contract, and because it is not practical potentially to have two 25 different firms working on essentially the same area, the Board of Directors finds that it is 26 impractical and unfeasible to submit this additional work to a competitive bidding process that [PAGE 1 OF 21 ORDINANCE To award a contract to Joyner, Ford & Burke for streetscape in the River Market and to dispense with competitive bidding I could not even be started until close the time for this work to be completed; therefore, to the 2 extent that it is necessary to dispense with competitive bidding, the City of Little Rock does so. 3 Section 3. Funds for this contract are available from funds made available through the 4 short term financing approved in Little Rock, Ark., Ordinance No. 19,157, passed on August 2, 5 2004, and additional funds will be made available from private donations. 6 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, 7 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 8 declaration or adjudication shall not affect the remaining portions of the ordinance which shall 9 remain in full force and effect as if the portion so declared or adjudged invalid or 10 unconstitutional was not originally a part of the ordinance. 11 Section 5. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent 12 with this ordinance, particularly including by not limited to Little Rock, Ark., Resolution No. 13 11,771 (June 15, 2004), are hereby repealed to the extent of such inconsistency. 14 Section 6. Emergency.
