WHEREAS, the Federal Age Discrimination in Employment Act has been amended to extend its protections to all workers above the age of 40; and, WHEREAS, it shall henceforth be the policy of the City of Little Rock to make all mandatory retirement decisions on the basis of an individualized assessment of the abilities and competence of the individual employee at issue without regard to the employee's age, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1: That Ordinance No. 13, 573 (uncodified) raising the City's mandatory retirement age from 65 to 70 be and hereby is repealed. SECTION 2: That Ordinance No. 12, 387 (uncodified) establishing the City's mandatory retirement age be and hereby is repealed. SECTION 3: DECLARING AN EMERGENCY. It is hereby found that, inasmuch as the Federal Age Discrimination in Employment Act has been amended to extend its protections to all workers above the age of 40, Ordinance Nos. 12, 387 and 13, 573 are facially violative of the Act. An emergency is therefore declared to exist, and this Ordinance shall be in full force and effect immediately from and after its passage.
