HomeMy WebLinkAbout15888• ORDINANCE NO. 15,888 • ORDINANCE ASKING THE BOARD OF DIRECTORS TO VACATE A POARTION OF EAST 13TH STREET WHEREAS, a petition was duly filed with the Board of M M 253 Directors of the City of Little Rock, Arkansas, on the 29th day of March, 1990, asking the Board of Directors to vacate and abandon a portion of East 13th Street lying between the East line of McAlmont Street and the Northwesterly right -of -way line of I -630, Masonic Addition to the City of Little Rock, Arkansas, as designated on the plat of said Addition now appearing of record in Plat Book AB, page 192, in the office of the Circuit Clerk and Ex- Officio Recorder of Pulaski County, Arkansas, subject, however, to any public utility easements in the said Street; WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has ascertained that the Street, hereinbefore described, has heretofor been dedicated to the public use as a street, as herein described; that petitioner is the sole owner of the property abutting upon the street to be vacated; and that public interests and welfare will not be adversely affected by the abandonment of said street; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all of its rights, together with U -At If Q -/1 0 0 the rights of the public generally, in and to the street designated as follows: That part of East 13th Street lying between the East Line of McAlmont Street and the Northwesterly Right -Of -Way Line of Interstate Highway I -630, said lands lying between Blocks 13 and 20 of Masonic Addition to the City of Little Rock, Pulaski County, Arkansas. Subject, however, to any public utility easements located in said Street. SECTION 2. The City specifically retains the right to use, and allow others to use, the former street right -of -way in its entirety as a public utility and drainage easement. SECTION 3. Abutting owners of record, receiving title to the abandoned right -of -way and easement of the street shall at their cost remove all vestiges of public use and access as may exist; such modification shall include, but are not limited, to the following: A. The entrances on both ends of the abandoned right -of -way and easement shall be off -set and /or rebuilt to conform to the standard driveway designed as required by ordinance No. 12501. B. The edge of pavement of the right -of -way shall be rebuilt to conform to existing conditions in the general vicinity where the abandoned right -of -way and easement intersects with the remaining public right -of -way. SECTION 4. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the office of the Pulaski County Circuit Clerk and Ex Officio Recorder and recorded in the Deed Records of the County. - 2 - 254 • 255 SECTION 5.
