3 AN ORDINANCE AMENDING IN PART ORDINANCE NO.
4 11,366 TO PROVIDE FOR LEVYING A FRANCHISE FEE
5 TO BE PAID BY ARKANSAS LOUISIANA GAS COMPANY
6 FOR THE YEAR 1991; PROVIDING FOR THE PAYMENT
7 THEREOF.

9 WHEREAS, the Arkansas Louisiana Gas Company (hereinafter
10 sometimes referred to as "Gas Company ") is or will be duly
11 authorized by franchise ordinance to operate a gas distribution
12 system and appurtenances thereto, used in or incident to the
13 rendition of gas service to Little Rock, Arkansas (hereinafter
14 referred to as "the City ") and the inhabitants thereof residing in
15 said municipality; and

WHEREAS, the Gas Company is now and will be occupying the
17
streets, alleys and rights -of -way of the City for the purpose of
18
operating, maintaining, and extending its gas services to the
19
municipality and supplying the municipality and consumers therein
20
gas service; and

22 WHEREAS, the City is entitled to receive such just and
23 reasonable fees from the Gas Company for such use, which the City
24 may lawfully impose and the Gas Company is obligated to pay.
25 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
26 THE CITY OF LITTLE ROCK, ARKANSAS;
27 SECTION 1. Section 1 of Ordinance No. 11,366, as amended, is

amended to read as follows:

30 For the year 1991, the Gas Company shall on a monthly
31 basis pay an amount equal to five and two - tenths percent
32 - (5.2 %) of the Gas Company's gross revenues as paid to it
33 during the calendar year 1991 by all of its customers,
34 including but not limited to industrial, residential and
35 commercial customers located within the corporate limits

of the City of Little Rock or the sum of Two Million
Three Hundred and Twenty -five Thousand Dollars
($2,325,000) per year, whichever is greater. Said gross
revenues shall be certified by an officer of the Gas
Company.

SECTION 2. Payments to the City by Arkansas Louisiana Gas
Company of the amounts as provided for in Section 1 hereof shall be
made monthly payable by the 15th of each month.
SECTION 3. All ordinances and parts of ordinances that
conflict herewith are hereby repealed; provided, however, only to
the extent that the same are in direct conflict herewith. Except
as provided, nothing herein shall be construed to alter or change
the terms or conditions of the present franchise under which the
Gas Company is operating.
SECTION 4. This ordinance shall be in effect on and after
January 1, 1991.
