3 AN ORDINANCE TO AMEND ORDINANCE NO.
4 15,765 MAKING A CHANGE IN TITLE, VARIOUS
5 CHANGES TO THE STANDARDS, AND FOR OTHER
6 PURPOSES.

8 WHEREAS, the Board of Directors is committed to the
9 implementation of the Highway 10 Land Use Plan; and
10 WHEREAS, the Board of Directors has established Design
11 Overlay Districts for the City of Little Rock; and
12 WHEREAS, the Board of Directors approved an interim overlay
13 district on Highway 10 as a method of dealing with inordinate and
14 immediate development demand pressures until more detailed review
15 could be accomplished; and
16 WHEREAS, the Planning staff and Overlay Review Committee
17 have examined the ordinance standards for appropriateness and,
18 after hearings with property owners for citizen input have
19 developed a set of overlay amendments; and
20 WHEREAS, the Planning Commission has also reviewed the
21 suggested changes, received comments from property owners and
22 interested citizens, and recommended modifications to the
23 ordinance; and
24 WHEREAS, due to the current rate of intense development
25 along the Highway 10 Corridor, the Board of Directors desires to
26 adopt ordinance amendments to the Design Overlay District for this
27 area; and
28 WHEREAS, the City of Little Rock intends to develop similar
29 Overlay Districts on other major roadways in the City upon
30 adoption of these permanent overlay amendments.
31 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
32 THE CITY OF LITTLE ROCK, ARKANSAS:
33 Section 1. The title of Ordinance 15,765 is amended to
34 delete the word "interim".
35 Section 2. Paragraph B, District Boundaries, is amended to
36 change the area within the District from 500 to 300 feet each side

of the right -of -way.

Section 3. Paragraph D, Site Design and Development

Standards, Section 1, Lot Size, is amended to agree with the
4
Highway 10 Land Use Plan minimum of 2 acres.

Section 4. Paragraph D, Site Design and Development

Standards, Section d., the berm requirement is replaced with
7
language to allow several techniques to achieve the desired effect
8
and should read as follows:

d. The Highway 10 frontage (front yard) shall consist of a
10
minimum of 40 feet of landscaped area exclusive of right -of -way.
11
The landscaped area shall contain organic and /or combined
12
man - made /organic features as berms, brick walls and dense
13
plantings such that vehicular use areas are screened when viewed
14
from an elevation of 42 inches above the elevation of the adjacent
15
street. Alternative screening methods and designs must be approved
16
by the Plans Review Specialist. Appeals from the staff will be
17
directed to the Planning Commission. Within the landscaped area
is
trees shall be planted or be existing at least every 20 feet and
19
have a minimum of 2 inches in diameter when measured 12 inches
20
from the ground at time of planting.

Section 5. Paragraph D, Site Design and Development

Standards, Section 7, Curb Cuts, is deleted and replaced with the
23
City standard as follows:

7. Curb Cuts -- Maximum: one (1) curb cut per 300 feet and
25
no curb cut . closer to an intersection than 100 feet.

Section 6. Paragraph D, Site Design and Development
27
Standards, Section 9, Building Sites, the schedule of size to
28
number of buildings is changed to read as follows: "one (1)
29
building every two (2) acres."
Section 7. Paragraph F, Exceptions, is amended to read as

follows:

F. Exceptions

Property due to topography, size, irregular shapes or other
34
constraints such as adjacent structures or features which
significantly affect visibility and thus cannot be developed
35
without violating the standards of this ordinance shall be

reviewed through the Planned Unit Development (PUD) section of the
Zoning Ordinance with the intent to devise a workable development
plan which is consistent with the purpose and intent of the
overlay standards.
Section S. Section 3 of Ordinance 15,765 is deleted.
Section 9. Except as amended herein, all of the remaining
provisions of Ordinance No. 15,765 remain in full force and
effect.
