AN ORDINANCE PROVIDING FOR THE VACATING
AND CLOSING OF A PORTION OF SPRUCE
STREET LYING BETWEEN WOODLAWN AVENUE
AND LEE STREET ADJACENT TO BLOCKS 24
AND 25 OF PULASKI HEIGHTS ADDITION.

WHEREAS, it has been determined that Spruce Street, as
designated on the plat of Pulaski Heights Addition adjacent to
Block 25, will not be needed for corporate purposes, except for
public utility drainage easement purposes, and
WHEREAS, the owners of the adjacent lots and blocks are
desirous of a phased development of church lands, and
WHEREAS, the Little Rock Board of Directors are desirous of
maintaining the quality of life of the environs of this church
and the safe and expeditious movement of pedestrians and
vehicles.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Except as provided in Sections 2, 3 and 4
below, the City of Little Rock, Arkansas hereby releases,
vacates and abandons all its rights, together with the rights of
the public generally, in and to the street designated as follows:
All of Spruce Street right -of -way lying
between the south right -of -way line of
Woodlawn Avenue and the north right -of -way
line of Lee Avenue between blocks 24 and
25 of Pulaski Heights Addition.
SECTION 2. The City of Little Rock specifically retains
the right to use and allow others to use the former Spruce
Street right -of -way as a pedestrian and vehicle thoroughfare
until the life estate reserved by Irene Whitehurst , pursuant to
Warranty Deed conveying title to Lot 5, Block 24, Pulaski
Heights Addition to the City of Little Rock to H. Maurice
Mitchell, Chairman of the Board of Trustees of Pulaski Heights
United Methodist Church, and recorded on December 5, 1990, as
Instrument Number 90- 65988, has been fully and completely
extinguished.

SECTION 3. The City of Little Rock specifically retains
the rights and interests of public utilities and drainage in,
over or beneath the said Spruce Street right -of -way.
SECTION 4. If within five (5) years of the passage of this
ordinance, the developer of the parking lot(s) on the abutting
lots sells or disposes of the land for purposes other than as
approved by the Little Rock Planning Commission by conditional
use permit, this ordinance shall be deemed invalid.
SECTION 5. This ordinance shall take effect and be in full
force thirty (30) days from its passage and approval.
