HomeMy WebLinkAbout16017= = M = M M = = = M = r 0 0 ORDINANCE NO. 16,017 AN ORDINANCE VACATING A PUBLIC UTILITY EASEMENT BETWEEN LOTS 240 AND 241 OF LONGLEA VII -A ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas on the 1st day of February. 1991, asking the Board of Directors to vacate all that portion of the public utility easement designated on the plat of the Longlea VII -A Addition (between Lots 240 and 241) to the City of Little Rock, Arkansas, now appearing of record in Plat Book A, Page 151, in the Office of the Recorder of Pulaski County, Arkansas. WHEREAS, after due notice as required by law, the Board has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the easement, or portion thereof, hereinbefore described, has heretofore been dedicated to the public use as a utility easement herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all the owners of the property abutting upon the portion of the utility easement to be vacated have filed with the Board their written consent to this action; and that public interest and welfare will not be adversely affected by the vacating of the utility easement. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION I. The City of Little Rock, Arkansas, releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the utility easement designated as follows: A 10 ft. Bride utility easement lying five feet on either side of the common property line between Lots 240 and 241 of Longlea VII -A Addition of the City of Little Rock, Arkansas. This does not affect the continuity of the 10 ft. easement along the back line of Lots 240 and 241. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County and recorded in the records of the County. 45 0 - -8 D I- SECTION 3. This Ordinance shall take effect and be in force from and after its passage and approval.
