HomeMy WebLinkAbout16115M ® M M M 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 M M M M M • ORDINANCE NO. 16,110 AN ORDINANCE AMENDING CHAPTER 22 AND CHAPTER 32 OF THE LITTLE ROCK CODE OF ORDINANCES, ESTABLISHING REGULATIONS FOR THE SAFETY OF CITIZENS USING CITY PARKS, FOR THE MAINTENANCE OF CITY PARK PROPERTY AND FOR THE PROTECTION OF ANIMATE IN CITY PARRS AND THE ZOO, DECLARING AN EMERGENCY, AND FOR OTHER MATTERS. is • NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. LRC §22 -23 entitled "Facility use permits" is amended to read as follows: (a) It shall be unlawful to use any facility or building for the following purposes without first obtaining permission from the Director of Parks and Recreation or a designee: (1) Recreational buildings for any purpose; (2) Special events on park property; (3) Lectures, concerts, political rallies, speeches or addresses. (b) Any person or group of persons with a permit shall have priority in the use of the facility for the time indicated on the permit, to the exclusion of all persons who do not hold a permit. (c) Facility use permits may be revoked for a violation of this chapter. SECTION 2. LRC §22 -23 entitled "Games" is hereby amended to be entitled "Sports" and to read as follows: It shall be unlawful to participate in sports and games involving thrown, kicked or otherwise propelled objects other than in areas designated for such activities. Hazardous sports such as football, soccer, baseball, golf and archery are allowed only on fields and courses provided therefor. SECTION 3. LRC §22 -33 entitled "Swimming, bathing, etc. ", is amended to read as follows: (a) It shall be unlawful to swim, bathe or wade in any lake, pond or fountain in the city parks. � 52 F'7 419 (b) Ipshall be unlawful for any person to swim in the 1 Arkansas River within the boundaries of city parks. 2 (c) "Swim" is defined as entering into the water above 3 the waist or propelling oneself in the water by the use of 4 arms or legs, with or without the use of flotation devices. 5 SECTION 4. LRC §22 -39 entitled "Animals" is amended to read 6 as follows: (a) It shall be unlawful to chase, snare, catch, tease, molest, injure or to antagonize animals in any way 8 in parks. 9 (b) It shall be unlawful to throw or fire any 10 projectile at or toward animals in parks or the zoo. (c) Horses may be ridden in parks only on designated 11 bridal trails. 12 (d) It shall be unlawful to permit dogs to run loose. 13 Dogs shall be restrained at all times on adequate leashes 14 not greater than five (5) feet in length. (e) No pets of any kind, other than animals trained 15 for handicapped persons, are allowed inside the zoo 16 confines or at Julius Breckling Riverfront Park during 17 Riverfest. 18 (f) It shall be unlawful to cross guard rails, fences, 19 or barricades in any park area confining animals, displays 20 or exhibits. (g) It shall be unlawful to poison or feed animals 21 spoiled food. 22 (h) It shall be unlawful to feed animals where signs 23 have been posted forbidding such practice, or to feed any 24 animal within the zoo confines. This provision shall not 25 apply to zoo personnel. SECTION 5. LRC §22 -43 entitled "Handbills" is amended to 26 read as follows: 27 (a) It shall be unlawful to paste, affix or inscribe 28 any handbill, poster, card, device, message, symbol or 29 advertisement anywhere in city parks without prior approval of the City Manager. 30 (b) Distribution of handbills and the gathering of 31 signatures on petitions are allowed by permit obtained from 32 the Director of Parks and Recreation. Such activity shall 33 be allowed during regular park hours and may be required to 34 locate in such a manner as not to impede pedestrian and vehicular traffic within the park. 35 36 i M M 1 (c) The permit holder shallbe responsible for 2 retrieving and disposing of material discarded by recipients of the material. 3 SECTION 6. LRC §22 -62 entitled "Payment of user fees 4 required" is amended to read as follows: 5 (a) It shall be unlawful to play on a municipal golf 6 course without having paid the proper use fee for such 7 privilege. (b) User privileges may be revoked for a violation of 8 this chapter. 9 SECTION 7. LRC §22 -25 entitled "Operating hours" shall be 10 deleted in its entirety. 11 SECTION 8. LRC Chapter 32, Article VI is hereby amended to 12 add the following provision: §32 -321. Park closing hours. 13 (a) It shall be unlawful for any person to park a 14 motor vehicle or to be on park grounds between 10:00 P.M. 15 and 5:00 A.M., unless the hours are otherwise posted. This 16 provision shall not apply to through traffic on public streets within the parks. 17 (b) The Director of Parks and Recreation shall have 18 the authority to extend park hours for approved scheduled 19 events. 20 SECTION 9. Severability. The provisions of this ordinance 21 are hereby declared to be severable and if any section, phrase, or provision shall be declared or held invalid, such invalidity 22 shall not affect the remainder of the section, phrases or 23 provisions. 24 SECTION 10. Conflict. All ordinances and parts of 25 ordinances in conflict herewith are hereby repealed to the 26 extent of the conflict. SECTION 11. Declaring an Emergency. The Arkansas River is 27 inherently dangerous to swimmers who may be unaware of the river 28 currents and undertow. Further, the preservation of City park 29 animals and property is deemed to be an integral part of the 30 City's investment in its future. Recent incidents of persons 31 drowning in the Arkansas River, damage to park property and endangering animals in the parks and zoo have come to the 32 attention of City officials without adequate code provisions to 33 effectively deal with these situations.
