3 AN ORDINANCE AUTHORIZING THE EXPENDITURE
4 OF $1,250,000 FOR THE PURCHASE OF A PARK
5 SITE FROM JOHN McDANIEL WITH FUNDS FROM
6 THE 1988 CAPITAL IMPROVEMENT BOND ISSUE;
7 AUTHORIZING THE TRANSFER INTO THE WEST
8 LITTLE ROCK PARK PROJECT FUND THE SUM OF
9 $250,000 FROM THE BOND ISSUE EXCESS
10 INTEREST EARNINGS ACCOUNT; AUTHORIZING
11 THE MAYOR TO ENTER INTO SIGN ANY
12 DOCUMENTS NECESSARY TO ACCOMPLISH THE
13 PURCHASE OF THE PARK SITE; AND FOR OTHER
14 PURPOSES.

16 WHEREAS, the 1988 Capital Improvement Bond Fund included
17 a 1,000,000 item for acquiring, constructing, equipping or
18 renovating a park in the City of Little Rock, Arkansas; and
19 WHEREAS by Little Rock, Ark., Resolution No. 8,838
20 (December 15, 1992) ( "LRR"), the Board of Directors of the City
21 of Little Rock has selected a park site presently owned by John
22 McDaniel which meets the criteria established by the Board in
23 LRR No. 8,796 (October 6, 1992); and
24 WHEREAS, the total cost of the land for this park site is
25 $1,250,000; and
26 WHEREAS, the 1988 Bond Issue Excess Interest Earnings
27 Account contains at least $250,000 to make up the difference
28 between the West Little Rock Park Project Account and the cost
29 of the property.
30 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
31 OF THE CITY OF LITTLE ROCK, ARKANSAS:
32 SECTION 1. The sum of $250,000 is hereby appropriated
33 from the 1988 Bond Issue Interest Excess Earnings Account to be
34 transferred to the West Little Rock Park Project -- Account No.
35 301 - 230 -0049.

SECTION 2. The Mayor, Clerk, and City Attorney are
authorized to draft, approve and execute any and all documents
necessary to effect the purchase of property from John
McDaniel, more fully described on Exhibit A to this ordinance,
for the sum of one million two hundred and fifty thousand
dollars ($1,250,000), inclusive of any and all costs necessary
to complete the agreement to be paid from Account No.
301 - 230 -0049 after the transfer referred to in Section 1.
SECTION 3. All ordinances and parts of ordinances
inconsistent with the provisions of this ordinance are hereby
repealed to the extent of such inconsistency.
