AN ORDINANCE VACATING A PUBLIC UTILITY EASEMENT
ON LOTS 619 AND 620 OF ST.CHARLES ADDITION TO
THE CITY OF LITTLE ROCK
WHEREAS, a petition was duly filed with the Board of Directors of the
City of Little Rock, Arkansas on the 14th day of August ,
1992, asking the Board of Directors to vacate all that portion of the public
utility easement designated on the plat of the St. Charles Addition to the
City of Little Rock, Arkansas, now appearing of record in Plat Book D, Page
512, in the Office of the Recorder of Pulaski County, Arkansas.
WHEREAS, after due notice as required by law, the Board has, at the time
and place mentioned in the notice, heard all persons desiring to be heard on
the question and has ascertained that the easement, or portion thereof,
hereinbefore described, has heretofore been dedicated to the public use as
a utility easement herein described; that all the owners of the property
abutting upon the portion of the utility easement to be vacated have filed
with the Board their written consent to this action; and that public interest
and welfare will not be adversely affected by the vacating of the utility
easement.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, releases, vacates and
abandons all its rights, together with the rights of the public generally,
in and to the utility easement designated as follows:
A portion of an existing sanitary sewer easement, Instrument No.
87- 37418, to be abandoned across Lots 619 and 620, St. Charles, an
Addition to the City of Little Rock, Arkansas, said easement more
particularly described as:
A 10 ft, wide sanitary sewer easement through Lots 619 and 620, St.
Charles, an Addition to the City of Little Rock, Arkansas, being
5 ft. right and 5 ft. left of the following described centerline:
Starting at the Northeast corner of said Lot 620; thence run
N89 °01'11 "W along the north line of said Lot 620, 68.74 ft.; thence
S12 °17'10 "W, 15.00 ft. to the point of beginning; thence S10 026124 "W
along the centerline of an existing sanitary sewer line crossing
said Lots 620 and 619, 273.11 ft. to a point 5 ft. north of a
sanitary sewer manhole and the point of termination.
SECTION 2. A copy of this ordinance, duly certified by the City Clerk,
shall be filed in the Office of the Recorder of Pulaski County and recorded
in the records of the County.
SECTION 3. This Ordinance shall take effect and be in force from and
after its passage and approval.
