3 AN ORDINANCE RATIFYING THE ACTIONS
4 OF THE CITY MANAGER IN CONTRACTING
5 WITH STALEY ELECTRIC CO. AND LITTLE
6 ROCK ELECTRIC CO. FOR INSPECTION OF
7 ELECTRICAL WIRING AT CITY PARRS AND
8 BALLFIELDS, AND FOR MAKING NECESSARY
9 REPAIRS; APPROPRIATING FUNDS;
10 DECLARING AN EMERGENCY; AND FOR
11 OTHER PURPOSES.

13 WHEREAS, there was recently a death at a City ballpark when
14 a young person was electrocuted upon coming into contact with a
15 guy wire that was part of the ballpark lighting system; and
16 WHEREAS, in addition to electrical inspection work already
17 ongoing at the various City parks, the City stepped up its
18 inspection and repair efforts; and
19 WHEREAS, it was determined by the City Manager that this
20 work needed be completed expeditiously and that it would be
21 inappropriate for the present electrical contractor to try to
22 undertake such work; and
23 WHEREAS, renewed competitive bidding was impractical and
24 unfeasible, particularly in light of the heightened concern for
25 the safety of persons using the parks; and
26 WHEREAS, both the Staley Electric Co. and the Little Rock
27 Electric Co. participated in earlier competitive bidding with
28 the City and maintained excellent reputations for workmanship
29 and the ability to promptly work on the City's electrical
30 problems; and
31 WHEREAS, the City Manager contracted with these companies
32 to perform necessary and immediate electrical work for the City,
33 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
34 THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1. The action of the City Manager in contracting
with Staley Electric Co. and the Little Rock Electric Co. for
work on various electrical projects in the City is hereby
ratified.
SECTION 2. The Board of Directors determines that
competitive bidding was impractical and unfeasible in light of
the need to address electrical problems at City ballparks and
park facilities immediately during summer months when such
facilities experience increased use.
SECTION 3. The sum of $155,000 is hereby appropriated from
unappropriated general fund monies for the purpose of the
contractual work necessitated by this ordinance.
SECTION 4. Emergency. The recent death of a young person at
a City park has lead to an inspection of facilities and a
realization of the need for immediate and additional repair work
at City facilities. Because of the increased summer usage of
these parks this work needs to be completed as soon as possible
to protect the health, safety and welfare of citizens using
these parks. An emergency is therefore declared to exist and
this ordinance shall be in full force and effect from and after
the date of its passage.
