AN ORDINANCE TO AMEND LITTLE ROCK,

ARK., REV. CODE SS 7 -126 and 7 -127 TO
5
ADD ANOTHER CLASSIFICATION OF
6
OFF - AIRPORT BUSINESSES, TO ESTABLISH
7
RATES TO BE ASSESSED ON THIS
8
CLASSIFICATION, DECLARING AN EMERGENCY
9
AND FOR OTHER PURPOSES.

WHEREAS, the Board of Directors of the City of Little
12
Rock has previously determined that it is necessary to permit
13
the Airport Commission to assess rates, fees, charges and
14
amounts for certain uses of the airport facilities, and
15
WHEREAS, these assessments are necessary to help retire
16
existing debts, pay for airport equipment, protect the public,
17
preserve order, provide for the public health, safety and
18
welfare, and to enhance the welfare and operational
19
capabilities of the airport, and
20
WHEREAS, certain off - premises parking facilities are
21
using airport facilities on a daily basis and are being
22
assessed a nominal amount for such use, and
23
WHEREAS, recent court cases have determined that a fee
24
for such use is justified because the revenues are based
25
solely on the revenues derived from passengers picked up at
26
the airport, and thus tie the fee directly to the benefit that
27
a business receives from the airport,

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
29
OF THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1. Little Rock, Ark. Rev. Code § 7 -126 (1987),

"Class "B ", is hereby amended to read as follows:

Class B: Off - airport businesses, not
33
including Class A and Class C
34
business, such as hotels and
35
motels that tansport persons to
36

1 SECTION 2: Little Rock, Ark., Rev. Code § 7 -126 (1987) is
2 hereby amended to add the following:
3 Class C: Off - airport businesses operating
4 parking facilities for the air
5 travelling public.
6 SECTION 3: Little Rock, Ark., Rev. Code § 7 -127 (1) is
7 hereby amended to read as follows:
8 (1) Licenses. Class A, Class B, and Class C
9 off - airport businesses shall apply to the
10 manager for original and renewal licenses to
11 operate at the airport. All applications shall
12 be accompanied by a payment of fifteen dollars
13 ($15.00) as a nonrefundable application fee.
14 SECTION 4: Little Rock, Ark., Rev. Code § 7 -127 (2) is
15 amended to add the following:
16 C. Class C. Each business operating an
17 off - airport parking facility for the air
18 travelling public shall pay a fee based
19 on the following calculation:
20 Thirty -five cents ($0.35) for each
21 vehicle entrusted to the parking
22 facility by an airport patron,
23 multiplied by the number of complete
24 days such patron's vehicle is entrusted
25 to the parking facility. A "complete
26 day" consists of a period of 24
27 consecutive hours, beginning at the time
28 such vehicle is entrusted to the parking
29 facility. With respect to period of
30 entrustment that either do not equal a
31 complete day or that exceed a complete
32 day yet do not equal a successive
33 complete day, the parking facility shall
34 pay a fee of ten cents ($.10) per hour
35 or partial hour, not to exceed thirty

five cents ($0.35) in any one complete
day.
This permit fee shall be payable monthly and
such payment shall entitle a licensee to a
permit which will authorize it to shuttle the
parking facility's customers to and form the
airport for one month.
SECTION 5. Emergency Clause. The ability to pay off
debts, provide for equipment, and efficiently operate the
airport is important to the public health, safety and welfare.
At the present, the revenue lost by a waiting period of this
ordinance to take effect could have a detrimental impact upon
the airport. An emergency is therefore declared to exist and
this ordinance shall be in full force and effect from and
after the date of its adoption.
