HomeMy WebLinkAbout16218• • 381 1 ORDINANCE NO. 16,218 2 3 AN ORDINANCE TO AMEND CHAPTER 32 OF 4 THE LITTLE ROCK CODE OF ORDINANCES, 5 REVISED (1988), TO EXEMPT POLICE 6 OFFICERS ON OFFICIAL BUSINESS FROM 7 THE PROHIBITION OF RIDING A BICYCLE 8 ON A SIDEWALK WITHIN A BUSINESS 9 DISTRICT; DECLARING AN EMERGENCY; 10 AND FOR OTHER PURPOSES. 11 12 WHEREAS, the Little Rock Police Department has implemented 13 a program of police patrol on bicycles furnished by the City to 14 officers on duty; and 15 WHEREAS, pursuant to the bicycle patrol program, it may be 16 necessary for an officer to ride a bicycle on sidewalks as 17 circumstances require; and 18 WHEREAS, Section 32 -494 of the Little Rock, Ark., Rev. Code 19 (1988) prohibits any person from riding a bicycle on a sidewalk 20 within a business district; and 21 WHEREAS, the Code should be amended to exempt police 22 officers patrolling on official business from the prohibition of 23 riding bicycles on sidewalks. 24 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 25 THE CITY OF LITTLE ROCK, ARKANSAS: 26 SECTION 1. Chapter 32, Article VIII, Section 32 -494 of the 27 Little Rock Code of Ordinances, Rev. (1988) is hereby amended to 28 read as follows: 29 Section 32 -494 Riding on sidewalks. 30 a. No person shall ride a bicycle upon a 31 sidewalk within a business district. 32 Whenever any person is riding a bicycle 33 upon a sidewalk outside of business 34 districts, such person shall yield the 35 right -of -way to any pedestrian and shall 36 40-617 C -r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 382 give audible signal before overtaking and passing such pedestrian. b. This section shall not apply to police officers acting in the line of duty as part of a City bicycle patrol, except that police officers riding on sidewalks shall operate the bicycle in a safe manner, yielding to the right -of -way and warning pedestrians to the extent possible. SECTION 2. EMERGENCY CLAUSE. The present City Code prohibits the riding of bicycles on sidewalks within business districts. Such activity may be necessary by a police officer on official duty in furtherance of the Little Rock Police Department bicycle patrol program. Implementation of this program, necessary for the health, safety and welfare of the citizens, is imminent.
