AN ORDINANCE GRANTING A FRANCHISE
FOR A PORTION OF THE ALLEY IN WEEKS
SUBDIVISION OF BLOCK 359 OF THE
ORIGINAL CITY OF LITTLE ROCK, AND
FOR OTHER PURPOSES.
WHEREAS, it has been determined that the entire 16' width
of the alley lying south of Lot 6 in the Weeks Subdivision of
Block 359, Original City of Little Rock, Arkansas, as designated
on the plat of said addition now appearing of record in Plat
Book G -3, page 128 in the office of the Recorder of Pulaski
County, Arkansas, is no longer being used for corporate
purposes, except for public utility and drainage easement
purposes; and
WHEREAS, the owner of an adjoining parcel of land, Mr. O.D.
Tucker, has requested a franchise for the use of this property
for purposes of erecting barriers and taking other actions to
assist in protecting his property from criminal activity.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. O.D. Tucker is granted a franchise for the use
of the entire 16' width of the alley lying south of Lot 6 of
Weeks Subdivision of Block 359, Original City of Little Rock,
Arkansas, subject to the following terms and conditions: (a)
the franchisee may erect barriers, fences, or other matters to
block the drive through this portion of the alley south of Lot
6, Weeks Subdivision of Block 359, Original City of Little Rock,
provided that upon the termination of this franchise the
alleyway will be returned to the condition in which it existed
at the time the franchise was first granted; (b) the franchisee
will keep the property and adjoining property free of all trash,
refuse, garbage, and any other items dumped within the area;
(c) the franchise will be for a term of three years at which
time it will be renewed by the City of Little Rock, Arkansas;
(d) the franchise is subject to any utility or drainage easement
presently in effect.
SECTION 2. Notwithstanding any provision concerning the
term of this franchise, this franchise may be immediately
revoked without penalty to the City of Little Rock upon a
declaration of the Board of Directors that the property is

needed for other municipal purposes. 222
SECTION 3. This franchise shall be recorded in the office
of the Recorder of Pulaski County, Arkansas, as a covenant
running with the land whose terms and conditions shall be
binding upon O.D. Tucker, his heirs and assigns forever, unless
such franchise is otherwise terminated.
