3 AN ORDINANCE VACATING A PORTION OF
4 MABELVALE TOWN PLAT AND CLOSING
5 PORTIONS OF THE RIGHT -OF -WAY OF MAIN
6 STREET, WEST THIRD STREET AND ALLEYS
IN BLACKS 4, 5, 12 AND 13, ALL IN
7 THE PLAT OF THE TOWN OF MABELVALE,
8 PULASKI COUNTY, ARKANSAS.

10 WHEREAS, the current owner of Blocks 4, 5, 12, and 13 of
11 the Town of Mabelvale Plat has made application for the vacation
of portions of said blocks for the purpose of reducing platted
12 land to acreage, pursuant to Little Rock, Ark. Rev. Code § 31 -11
13 (1988); and
14 WHEREAS, the owner has not sold any of the lots within the
15 described area and he is the sole owner of the area to be
16 reduced to acreage; and
WHEREAS, none of the dedicated streets and alleys within
17 the described area have been constructed; and
18 WHEREAS, certain platted public utility easements within
19 the area of the plat to be vacated and reduced to acreage are
20 not vacated by this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
21 THE CITY OF LITTLE ROCK, ARKANSAS:
22 SECTION 1. The Board of Directors of the City of Little
23 Rock, Arkansas hereby approves the vacation of portions of the
24 plat of the Town of Mabelvale described herein, together with
25 the divesting of the public rights in the streets and alleys
included in the legal description of the portion to be vacated,
26 described as follows:
27 Part of the SE 1/4 of the SW 1/4 AND Part of
28 the SW 1/4 of the SE 1/4 of Section 3,
29 Township 1 South, Range 13 West, Pulaski
30 County, Arkansas, including part of Blocks 4,
5, 12 and 13 of the Town of Mabelvale, as
31 shown in Plat of record in Plat Book 1, at
32 page 157, more particularly described as
33 follows, to wit:

35 Beginning at a point 150.0 feet Northeast of
the Northwest corner of Block 21, Town of

1 Mabelve; thence northwesterly hrough the
center of Blocks 12 and 5, a distance of 686.0
2 feet to the center of a branch; thence
3 Easterly along said center of branch to the
4 North and South centerline of Section 3,
5 Township 1 South, Range 13 West, said point
6 being 380.88 feet south of the Northwest
corner of the SW 1/4 SE 1/4 of said Section 3,
7 Township 1 South, Range 13 West and also being
8 the Northwest corner of Tract 1 of Pine Manor
9 Subdivision as recorded in Plat Book 27 at
10 page 15; thence South 00° 25' West along the
11 westerly line of said Tract 1 of Pine Manor
Subdivision a distance of 203.0 feet; thence
12 North 500 54' East along the Southwesterly
13 line of said Tract 1 of Pine Manor Subdivision
14 a distance of 188.0 feet; thence South 30°
15 19' East along the Westerly line of said Tract
1 of Pine Manor Subdivision a distance of

172.0 feet; thence South 890 51' East along
17 the South line of Tract 1 of Pine Manor
18 Subdivision a distance of 8.23 feet to the
19 Easterly line of Block 13 of said Town of
20 Mabelvale; thence South 34° 00' East along
said East line of Block 13 a distance of
21 136.75 feet to the Northeast corner of Block
22 20 of said Town of Mabelvale; thence South
23 55° 45' West along the Northerly line of
24 Blocks 20 and 21 of said Town of Mabelvale a
25 distance of 530.0 feet to the point of
beginning, containing 5.51 acres, more or
26 less.

28 SUBJECT TO the new right -of -way of Mabelvale
29 Pike and Main Street. PROPERTY ALSO SUBJECT TO
30 any and all Easements, Streets and /or Alley
rights -of -way presently platted or otherwise
31 of record.
32 SECTION 2. The City specifically retains the public
33 in and to certain utility easements within the described
34 identified as follows:
35 1. A Right -of -Way Easement dated January 16,
1981, conveyed by the Jonas Corporation

Pulaski County Deed Records, Instrument
No. 83- 00705; and
3. A Right -of -Way Easement conveyed by Jonas
Corporation to Mabelvale- Alexander Sewer
Improvement District No. 142 dated
January 15, 1981, filed of record in the
Pulaski County Deed Records, instrument
No, 81- 05651.
SECTION 3. This ordinance shall be in full force and
effect from and after the date of its passage.
