HomeMy WebLinkAbout16540a a h u M a �o El N M M r i W 0 BE ORDINANCE NO. 16, 540 AN ORDINANCE APPROVING A PLANNED UNIT DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DEVELOPMENT DISTRICT TITLED SIPES SHORT -FORM PCD (Z- 3117 -E), LOCATED AT 7415 ASHER AVENUE, IN THE CITY OF LITTLE ROCK, ARKANSAS, AMENDING CHAPTER 36 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zone classification of the following described property be changed from C -3 to PCD. A parcel of land in Section 13, T -1 -N, R -13 -W, and located at 7415 Asher Avenue, Little Rock, Arkansas, being more particularly described as follows: Commencing at the Southwest corner of Section 13, thence run East 458.7' to a point of beginning, thence run N 00 029' E 841.01' to a point on the South right -of -way line of Asher Avenue, thence run N 56 037' E along said right -of -way line 286.44' to a point, thence run S 00 029' W 998.6' to a point, thence run West 237.6' to the point of beginning, containing 5.0 acres, more or less. SECTION 2. That the change in zoning and establishment of the PCD is subject to the following conditions proposed by the applicant: (A) The north 335' (measured along the West property line as shown in the site land survey dated August 18, 1992) shall retain uses listed as "permitted uses" in the C- 3, General Commercial District, zoning district. (B) The south 506.01' (measured along the said West property line), shall be used as a contractor's maintenance yard for TARCON, INC., Roy C. Tobey, President, with the following conditions applying: (1) There is to be no outside storage or display of materials. (2) There is to be no permanent storage of inoperative equipment or vehicles. C� Q (pq 0 7 09 M M M M 0 (3) Parking of limited to equipment: 690 contractor's "rolling stock" is to be the following numbers and types of (a) six (6) 2 -ton trucks or equivalent (b) two (2) 1 -ton trucks or equivalent (c) one (1) 1/2 -ton pick -up truck or equivalent (d) three (3) backhoe /loader excavators (e) three (3) portable axle mounted air compressors (f) three (3) 3 -axle low boy equipment trailers (g) three (3) miscellaneous utility type trailers (h) one (1) ditch witch trencher with trailer (C) A current survey /site plan is to be provided which shows all site improvements and shows the width of the Asher Avenue right -of -way. (D) Additional Asher Avenue right -of -way is to be dedicated to the City if the required survey indicates that there is less than 45' of right -of -way on the south side of the Asher Avenue center line so that the amount of right -of -way shall be not less than 45' measured from the Asher Avenue center line. (E) The applicant is to comply with the utility comments which were reported in the Planning Commission agenda of November 16, 1993. SECTION 3. That the change in zoning classification contemplated for SIPES SHORTL -FORM PCD is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36- 454(d) of the Code of Ordinances. SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and it is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof.
