AN ORDINANCE CALLING A SPECIAL ELECTION
IN THE CITY OF LITTLE ROCK, ARKANSAS, ON
THE QUESTION OF LEVYING A ONE -HALF
PERCENT (1/2 %) MUNICIPAL SALES AND USE
TAX PURSUANT TO ARKANSAS CODE ANNOTATED
SS 26 -75 -201 ET SEQ. FOR THE GENERAL
PURPOSES OF THE CITY; PRESCRIBING OTHER
MATTERS PERTAINING THERETO; AND
DECLARING AN EMERGENCY.
WHEREAS, the City of Little Rock, Arkansas (the "City ") is
a city of the first class; and
WHEREAS, the Board of Directors of the City has determined
that it would be in the best interests of the City to increase
police and fire protection throughout the City; and
WHEREAS, this increase cannot be funded with existing City
general revenues; and
WHEREAS, cities are authorized to levy a one -half percent
(1/2 %) municipal sales and use tax for such purposes pursuant to
Ark. Code Ann. SS 26 -75 -201 et seq.; and
WHEREAS, the voters of the City of Little Rock should be
asked to approve the tax at a special election.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. There is hereby levied a one -half percent sales
and use tax contingent on approval by the voters at a special
election.
SECTION 2. That there be, and there is hereby called, a
special election to be held on December 14, 1993, at which
election there shall be submitted to the electors of the City
the following question:
LEVY OF ONE -HALF PERCENT (1/2 %) SALES AND USE TAX
AUTHORIZATION AND APPROVAL OF LEVY OF ONE -HALF
PERCENT (1/2 %) SALES AND USE TAX WITHIN THE CITY OF
LITTLE ROCK TO BE USED FOR ANY PURPOSE FOR WHICH
THE CITY'S GENERAL FUNDS MAY BE USED.
The authorization and approval of the levy of
one -half percent (1/2 %) sales and use tax within
the City of Little Rock contained in Ordinance No.

Proceeds of the sales and use tax will be used for
any purpose for which the City's general funds may
be used. The sales and use tax shall be levied on
the receipts from the sale at retail within the
City of all items which are subject to taxation
under the Arkansas Gross Receipts Tax Act of 1941,
as amended, and the receipts from storing, using or
consuming within the City tangible personal
property under the Arkansas Compensating Tax Act of
1949, as amended.
Vote on measure by placing an x in the square
opposite the measure either for or against:
FOR adoption of a one -half percent (1/2 %)
local sales and use tax within the City of Little

SECTION 3. That the election shall be held and conducted
and the vote canvassed and the results declared under the law
and the manner now provided for municipal elections, unless
otherwise provided in the Authorizing Legislation, and only
qualified voters of the City shall have the right to vote at the
election.
SECTION 4. That the results of the election shall be
proclaimed by the Mayor, and his Proclamation shall be published
one time in a newspaper having a general circulation within the
City, which Proclamation shall advise that the results as
proclaimed shall be conclusive unless attacked in the courts
within thirty days after the date of publication.
SECTION 5. That a copy of this ordinance shall be given to
the Pulaski County Board of Election Commissioners so that the
necessary election officials and supplies may be provided. A
certified copy of this ordinance shall also be provided to the
Commissioner of Revenues of the State of Arkansas as soon as
practical.
SECTION 6. That the Mayor and City Clerk, for and on behalf
of the City, be, and they are hereby authorized and directed to

do any and all things necessary to call a• hold the specia E
election as herein provided, and, if the levy of the Sales and
Use Tax is approved by the electors, to cause the Sales and Use
tax to be collected in accordance with Arkansas Code Annotated
SS 26 -75 -201 et seq., and to perform all acts of whatever nature
necessary to carry out the authority conferred by this
Ordinance.
SECTION 7. That the funds collected pursuant to this
ordinance shall be appropriated by the Board of Directors and
used solely for the purposes expressed in this ordinance.
SECTION 8. SEVERABILITY. If any part of this ordinance is
held invalid, such invalidity shall not affect any other portion
of this ordinance.
SECTION 9. REPEALER. That all ordinances and parts thereof
in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 10. EMERGENCY CLAUSE. It is hereby found and
determined by the Board of Directors of the City of Little Rock
that the increase in violent crime in the City is dangerous to
the public health and welfare; and that this ordinance is
necessary to provide for an election on the issue of increasing
the sales tax to provide for funds to increase the public
safety. Therefore, an emergency is declared to exist; and this
ordinance being necessary for the preservation of the public
peace, health and safety, shall be in full force and effect from
and after its passage and approval.
