AN ORDINANCE To AMEND CHAPTER 12 OF
THE LITTLE ROCK, ARK. REV. CITY CODE
OF ORDINANCES BY PROHIBITING IMPROPER
HANDLING OF SNORING MATERIALS.
WHEREAS, there previously was an ordinance prohibiting the
improper handling of smoking materials in the City of Little Rock,
which was removed during recodification; and
WHEREAS, there have been a number of fires within the City
of Little Rock in recent months which have been caused by improper
handling of smoking materials; and
WHEREAS, these fires have resulted in loss of life, and
loss of property; and
WHEREAS, the health, safety and welfare of the general
public will continue to be endangered by individuals engaging in
these activities within the City of Little Rock,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Chapter 12 of the Little Rock Code of Ordinances
is hereby amended to add Section 6 as follows:
Careless Disposition of Smoking Materials banned.
(a) It shall be unlawful for any person to
carelessly set fire to, burn or cause to be burned
any grass, field, tree or shrubbery, or any
bedding, furniture, curtains, draperies or any
other household furnishings by means of any
lighted cigarettes, cigars, pipes or other form of
burning tobacco, or other smoking material, or
by means of matches, lighters and the like, in
lighting or attempting to light or failing to
properly extinguish and dispose of any cigarette,
cigar, pipe or other form of smoking material.
(b) Severability. If any provision or clause of
this ordinance or the application thereof to any

person or circumstances is held to be
unconstitutional or to be otherwise invalid by any
court of competent jurisdiction, such invalidity
shall not effect other ordinance provisions or
clauses or applications thereof which can be
implemented without the invalid provision or
clause or application, and is listed in the
provisions and clauses of this ordinance and
declared to be severable.
SECTION 2. Emergency clause. There have been an increasing
number of fires within the City of Little Rock which are directly
related to the improper use and extinguishment of smoking
material. These fires have caused loss of life and property, and
continue to be a danger to the citizens of this city. This
ordinance is necessary to preserve the public health, safety and
welfare. An emergency is declared to exist and this ordinance
shall be in full force and effect from and after the date of its
passage.
