4 AN ORDINANCE TO DESIGNATE THE WARD
POSITIONS TO BE ELECTED AT A SPECIAL
5 ELECTION TO BE CALLED FOR TUESDAY, NOVEMBER
6 16, 1993; TO DESIGNATE THE POSITIONS OF
7 THE BOARD OF DIRECTORS TO BE ELECTED AT THE
8 GENERAL ELECTION TO BE HELD IN 1994; TO
9 DESIGNATE THE POSITIONS OF THE BOARD OF
DIRECTORS TO BE ELECTED AT THE GENERAL
10 ELECTION TO BE HELD IN 1996; DECLARING AN
11 AGENCY; AND FOR OTHER PURPOSES.

13 WHEREAS, the Board of Directors adopted Little Rock,
14 Ark., Res. No. 8,870 (February 24, 1993), which approved
the recommendation of Future - Little Rock and sought the
15 adoption of a method of selecting Directors and a Mayor and
16 sought the enactment of state enabling legislation; and
17 WHEREAS, the General Assembly enacted Act 1294, which
18 was signed into law with an emergency clause on April 22,
19 1993, which provided the legal framework to adopt the
Future - Little Rock recommendations; and
20 WHEREAS, through Little Rock, Ark., Ord. No. 16,435
21 (June 1, 1993), the Board of Directors directed that a
22 special election be held on July 27, 1993, to permit the
23 citizens to vote for the change in government; and
24 WHEREAS, the Board adopted Little Rock, Ark., Res.
No. 8,954 (July 6, 1993), which indicated how the new
25 positions would be filled, and how the positions at the
26 succeeding two elections would be filled; and
27 WHEREAS, the citizens voted in favor of restructuring
28 the manager form of government to elect an eleven member
Z9 board of directors comprised of seven directors elected
from wards -- the ward boundaries to be decided by the
30 Pulaski County Election Commission -- three members to be
31 elected at- large, and a directly elected mayor; and
32 WHEREAS, the resolution of intent concerning the
33 selection of ward positions was made more formal by Little
34 Rock, Ord. No. 16,469 (August 3, 1993); and
WHEREAS, on August 25, 1993, the Pulaski County
35 Election Commission issued a map of the new ward

1 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
2 THE CITY OF LITTLE ROCK, ARKANSAS:
3 SECTION 1. The Board states its intent that the Mayor
4 proclaim a special municipal election to be held on
5 Tuesday, November 16, 1993, to, among other things, elect
four new members to the Board of Directors.
6 SECTION 2. (a) The members to be elected at this
7 special municipal election will take office on the first
8 Monday after the election results have been certified and
9 will serve until their successors, elected at the general
10 municipal election to be held in November, 1994, are sworn
in according to law;
11 (b) Except as provided in subsection (a), or as
12 otherwise provided by law, members of the Board of
13 Directors, including the Mayor, shall serve a term of four
14 years.
SECTION 3. The persons elected as directors at this
15 special election shall reside in and shall be elected from
16 electors living within one of the following wards: Ward 1;
17 Ward 2; Ward 5; and Ward 6.
18 SECTION 4. The persons elected at the November, 1994,
19 general municipal election shall include:
(a) the ward positions designated in Section 3, and
20 (b) three additional directors who shall reside in
21 and shall be elected by electors living within
22 one of the following wards: Ward 3; and Ward
23 7, and
24 (c)(i) a Mayor to be directly elected by all of the
electors within the City;
25 (ii) At the election for Mayor, the candidate
26 receiving 40% of the total votes cast shall be
27 deemed the Mayor. If no candidate receives 40%
28 of the total votes cast, then a run -off election
shall be held no later than two weeks later

i between the two candidates receiving the highest
30 number of votes in the first election. The
31 candidate receiving the most number of votes in
32 this run -off election shall be the Mayor.
33 SECTION 5. The persons elected at the November, 1996,
34 general municipal election shall include one person who
shall reside in and shall be elected by electors living
35 within Ward 4; in addition, three persons shall be elected

city.
SECTION 6. Severability Clause. In the event any
title, subtitle, section, subsection, subdivision,
paragraph, subparagraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be
invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of
this ordinance which shall remain in full force and effect
as if the portion so declared or adjudged invalid or
unconstitutional was not originally a part of the
ordinance.
SECTION 7. Emergency Clause. State law requires the
Board of Directors, within a reasonable time after the
July, 1993, election. to call a special election to fill
the new director positions. The Board desires to hold this
election on Tuesday, November 16, 1993, and is required by
law to have candidates file petitions to run for office at
least 60 days prior to this election. In order to give
potential candidates time to consider a race from within a
particular ward, it is necessary to designate, as soon as
possible, the specific ward representatives that shall be
elected. The election of candidates to the Board of
Directors is essential to maintain the public health,
safety and welfare. An emergency is therefore declared to
exist and this ordinance shall be in full force and effect
from and after the date of its adoption.
