HomeMy WebLinkAbout16441� M M M M M M M 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 0 0 ORDINANCE NO. 16,441 AN ORDINANCE AMENDING LITTLE ROCK ORDINANCE NO. 16,437, PROVIDING FOR CREMATORIA TO BE ALLOWED IN CERTAIN ZONING DISTRICTS BY CONDITIONAL USE PERMIT ONLY; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES 336 WHEREAS, Little Rock Ordinance No. 16,437, ( "LRO") adopted June 9, 1993, provided that a crematorium, as defined therein, shall only be allowed within the City by a conditional use permit; and WHEREAS, Section 3 of the ordinance deleted crematorium as a permitted use in C -3, C -4 and I -2 Zoning Districts; and, WHEREAS, it is the intent of the ordinance to allow crematorium only by conditional use permit in C -3, C -4 and I -2 Zoning Districts. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Section 3 of LRO No. 16,437 is hereby amended as follows: The following sections of Little Rock Code of Ordinances are hereby amended by deleting the word "crematorium" and relettering the uses accordingly: (a) Section 36 -301 (c)(1) (b) Section 36 -302 (c)(1) (c) Section 36-320 (c)(1). SECTION 2. The following sections of Little Rock Code of Ordinances are hereby amended by adding the word "crematorium" and relettering the uses accordingly: (a) subparagraph "i" of Section 36 -301 (c)(2) (b) subparagraph "f" of Section 36 -302 (c)(2) (c) subparagraph "b" of Section 36 -320 (c)(2) SECTION 3. Rev. Code (1988) is hereby amended to state that this article does not apply to crematoria. SECTION 4. Section 36 -153 of the Little Rock, Ark. Rev. Code (1988) is hereby amended by adding a new paragraph (f) to read as follows: (f) Crematoria in existence on the effective date of this ordinance are declared to be nonconforming. Such crematoria shall not be required to obtain a conditional use permit so long as the use is not expanded, changed, abandoned or discontinued as provided in this section. SECTION 5. Severability. In the event any portion of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not defect the remaining portions of this ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this ordinance. SECTION 6. Declaring an Emergency. It is hereby found and declared that the construction and location of crematoria is a matter which must be regulated by public input and public hearings. Therefore, this ordinance is necessary to protect the public health, safety and welfare, and shall be in full force and effect from and after its passage and approval.
