NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City approves implementation of the provisions of Act 239 of 1993 to the eligibility requirements for the Little Rock Municipal Judge's Retirement Fund. Representative Brown ACT 2 3 9 1993 A Bill For An Act To Be Entitled "AN ACT-TO AMEND ARKANSAS CODE 24 -8 -307 PERTAINING TO RETIREMENT BENEFITS OF MUNICIPAL COURT JUDGES; AND FOR OTHER PURPOSES." 139 HOUSE BILL 1.0'R 3 Subtitle "TO AMEND ARKANSAS CODE 24 -8 -307 PERTAINING TO RETIREMENT BENEFITS OF MUNICIPAL COURT JUDGES." BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: SECTION 1. Arkansas Code 24 -8 -307 is amended by inserting an additional paragraph at the end thereof to read as follows: "(e) Upon the approval of a majority of the city council or board of directors of a city of the first or second class, any person who shall attain the age of fifty (50) and who shall have served two (2) or more years as an elected justice of the peace and three (3) or more years as a certified full time law enforcement officer and has held the office of municipal judge not less than ten (10) years shall be eligible to receive retirement benefits provided by t =is subchapter. If the Judge resigns, retires from office, or is succeeded in office by another judge, he shall receive retirement benefits for and during the remainder of his natural life in an amount equal to one -half (1/2) of the salary payable to him at the time of his resignation, retirement, or succession in office. If incapacitating illness or disability should occur during the final term for qualification under these provisions, then the judge so elected shall be eligible to retire at the one -half (112) pay as provided in this secticn. In additional thereto, the surviving widow of the qualifying — judge shall be entitled to the benefits provided in this subchapter, until her c l death or remarriage." X RRS03 a i i1B 1 SECTION 2. All provisions of this act of a general and permanent nature 2 are amendatory to the Arkansas Code of 1987 Annotated and the Arkansas Code 3 Revision Commission shall incorporate the same in the Code. 4 5 SECTION 3. If any provision of this act or the application thereof to 6 any person or circumstance is held invalid, such invalidity shall not affect 7 other provisions or applications of the act which can be given effect without 8 the invalid provision or application, and to this end the provisions of this 9 act are declared to be severable. 10 11 SECTION 4. All laws and parts of laws in conflict with this act are 12 hereby repealed. 13 14 SECTION 5. EMERGENCY. It is hereby found and determined by the 15 General Assembly that the retirement eligibility law for municipal judges is 16 inadequate; that this act makes the necessary changes to include eligibility 17 criteria not now in the law; and that this act should be given effect as soon 18 as possible.
