HomeMy WebLinkAbout16335r M= M= M= M M M M M M M • • 3 1 ORDINANCE NO. 16 3:;F 2 3 4 AN ORDINANCE DISPENSING WITH THE 5 REQUIREMENT FOR COMPETITIVE BIDDING 6 FOR DEMOLITION OF A BUILDING AT THE 7 FOURCHE CREEK WASTEWATER TREATMENT 8 PLANT; AND DECLARING AN EMERGENCY. 9 10 WHEREAS, the Board of Directors may dispense with the 11 requirement of competitive bidding in exceptional situations where 12 such procedure is not feasible; and 13 WHEREAS, the Little Rock Sanitary Sewer Committee through 14 its operating authority the Little Rock Wastewater Utility has 15 requested the Board of Directors of the City of Little Rock to 16 adopt an ordinance as soon as practical dispensing with competitive 17 bidding for a contract to perform the demolition of a certain 18 building located at the Fourche Creek Wastewater Treatment Plant 19 ( "RBC building "), due to the urgency and nature of the demolition 20 needed and the fact that a contract for this demolition can be 21 negotiated on satisfactory terms to accomplish the necessary work; 22 and 23 WHEREAS, it is in the best interest of the City of Little 24 Rock to dispense with competitive bidding in order to have the RBC 25 building demolished as soon as possible on the most advantageous 26 terms and conditions and an emergency now exists to accomplish 27 this work. 28 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 29 THE CITY OF LITTLE ROCK, ARKANSAS: 30 SECTION 1. The Board of Directors hereby finds that 31 competitive bidding for a contract to demolish the RBC building at §2 the Fourche Creek Wastewater Treatment Plant shall be dispensed 33 with and the Little Rock Sanitary Sewer Committee through its 34 operating authority the Little Rock Wastewater Utility is hereby 35 authorized to proceed to negotiate a contract for the demolition 36 E-7 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 of the RBC building as soon as possible on terms and conditions which are advantageous to the City and in the best interest of the City of Little Rock. SECTION 2. Declaring an emergency. It is hereby found and declared that the Little Rock Sanitary Sewer Committee through its operating authority the Little Rock Wastewater Utility needs to enter into a privately negotiated contract for the demolition of the RBC building as soon as possible. Therefore, an emergency is declared to exist, and this ordinance is necessary to protect the public health, safety, and welfare and shall be in full force and effect from and after its passage and approval.
