ORDINANCE NO. 15,046 AN ORDINANCE AMENDING ORDINANCE NO. 15,043 REASSESSING THE VALUE OF BENEFITS TO BE RECEIVED BY THE OWNERS OF CERTAIN OF THE SEVERAL BLOCKS, LQTS AND PARCELS OF LAND WITH MABELVALE- ALEXANDER SEWER IMPROVEMENT DISTRICT NO. 142 OF THE CITY OF LITTLE ROCK, ARKANSAS, FOR OTHER PURPOSES; AND DECLARING AN EMERGENCY. WHEREAS, the Board of Directors of the City of Little Rock, Arkansas, adopted Ordinance No. 15,043 ( "Ordinance 15,043 ") on January 7, 1978, reassessing the value of benefits to be received by the owners of certain of the several blocks, lots and parcels of land within Mabelvale- Alexander Sewer Improvement District No. 142 of the City of Little Rock, Arkansas ( "District "), pursuant to the 1986 Reassessment as defined in Ordinance 15,043; and WHEREAS, Ordinance 15,043 deferred the reassessment of three parcels owned in the name of Otter Creek Mall and identified as the Parcels Being Deferred in Ordinance 15,043, and the Board of Directors now wish to establish the reassessment for those deferred parcels; and WHEREAS, the Board of the Directors of the City has further determined to extend the public hearing and make further amendments to Ordinance 15,043 with regard to certain parcels owned by property owners who appealed their assessment and were not able to be heard at the meeting of the Board of Directors of the City on January 7, 1986; mm 0-�b M M = M WHEREAS, the Board of Directors after hearing further appeals of certain property owners and after a reconsideration of the Parcels Being Deferred, has determined that further revisions to the 1986 Reassessment should be made as set forth in this Ordinance, and that as revised the benefits received by each and every block, lot and parcel of real property situated in the District equal or exceed the local assessment therefor. NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the City of Little Rock, Arkansas: Section 1. That those Parcels Being Deferred pursuant to Ordinance No. 15,043 are now reassessed as follows: Owner Otter Creek Mall Parcel No. 11- 13 -15 -04 03- 9003 -04 1986 Reassessment (Assessed Benefits) 629,376 11- 13 -15 -09 42,000 03- 3000 -01 11- 13 -1s -09 195,000 03- 3000 -00 Provided, the parcels reassessed in this Section 1 shall be subject to further reassessment and revision in 1989, or sooner, if the regional shopping center currently planned for this site is constructed prior thereto. Section 2. That the 1986 Reassessment is hereby amended for the following parcels identified as follows: 1986 Reassessment Owner Parcel No. (Assessed Benefits) Phelps Fan Mfg. Co. 11- C48 -03 30,000 Jimmy Jones 000 - 001 -00 11- 137SO8 03- 5100 -01 -2- 5,620 W 0 0 Section 3. That as a result of the revisions to the 1986 Reassessment as set forth in Section 1 and Section 2 herein and as further shown in the Amendment to 1986 Reassessments attached and made a part of this Ordinance, the total assessed benefits as revised herein and reflected on the assessment list of the District as amended by the 1986 Reassessment amounts to $22,303,316. That each of the lots, blocks and parcels of real property in the District be assessed according to the assessment list of the District pursuant to Ordinance 13,965 and certain parcels be reassessed as reflected in the 1986 Assessment attached to Ordinance 15,043 and as further amended by this Ordinance and the same shall remain a part of the records of the City Clerk Section 4. The levy established in Section 2 of Ordinance 15,043 is hereby ratified and confirmed. Section 5. Ordinance 15,043 is hereby specifically amended as set forth herein and all ordinances and resolutions and parts thereof in conflict herewith are hereby repealed to the extent of such conflict, and this Ordinance shall be in full force and effect from and after its passage. Section 6. That there is hereby found and declared to be an immediate need for reassessing the value of benefits to be received by the owners of certain of the blocks, lots and parcels of land within the District and otherwise benefit the public health, safety and welfare of the City and the and the -3- 70 inhabitants thereof, and said reassessment and other action authorized hereby is immediately necessary for the accomplishing of these public benefits and purposes. It is, therefore, declared that an emergency exists and this Ordinance being necessary for the immediate preservation of the public peace, health and safety shall be in full force and effect immediately upon and after its passage.
