ORDINANCE NO. 15,138 259
AN ORDINANCE CONDEMNING PARCELS OF REAL PROPERTY WITHIN THE
CITY OF LITTLE ROCK, ARKANSAS FOR THE RELOCATION,
RECONSTRUCTION, WIDENING AND IMPROVING OF JOHN BARROW ROAD;
DIRECTING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION
PROCEEDINGS.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The City of Little Rock does hereby condemn
for public purpose being the relocation, reconstruction, widening
and improving of John Barrow Road in Western Little Rock, the
following parcels of real property lying in the City of Little
Rock, County of Pulaski. State of Arkansas, to -wit:
1. A parcel of land situated in Lots 1, 2 and 3, Block 163,
John Barrow's Addition to the City of Little Rock,
Pulaski County, Arkansas, being more particularly bound
and described as follows:
Beginning at a found iron pin at the northeast corner of
said Lot 3; thence S O1 040115" W along the existing west
right -of -way line of John Barrow Road, 144.70 feet to
the southeast corner of said Lot 1; thence N 88 000116"
W along the south line of said lot, said south lot line
also being the north right -of -way line of West 42nd
Street, 25.24 feet; thence along the proposed west
right -of -way line of John Barrow Road N 36 030118" E,
31.51 feet and N O1 °40115" E, 118.68 feet to the north
line of said Lot 3; thence S 88 °23152" E along said
north lot line, 7.24 feet to the Point of Beginning;
said tract containing 0.029 acre (1,281 S.F.), more or
less;
29 -E:
And also a strip of temporary construction easement, 10
feet in width, lying west of, adjacent to, and parallel
with the tract described above, for use during street
widening only; said strip of temporary construction
easement containing 0.035 acre (1,520 S.F.), more or
less.
2. A parcel of land situated east of John Barrow Road and
north of Asher Avenue, said tract being part of the
NE1 /4, NW1 /4, Section 23, Township 1 North, Range 13
West, Pulaski County, Arkansas, being more particularly
bound and described as follows:
Beginning at the intersection of the existing east
right -of -way line of John Barrow Road with the existing
north right -of -way line of Asher Avenue; thence N 00°
49145" E along said existing east right -of -way line,
181.21 feet; thence S 89 012127" E, 1.00 feet; thence
along the proposed east right -of -way line of John Barrow
Road the following courses and distances: S 00 049145" W,
50.00 feet; thence S 89 012127" E, 3.50 feet, S 00 049'45"
E, 88.53 feet and S 48 004106" E, 52.46 feet; thence N
87 059139" E along the proposed north right -of -way line
of Asher Avenue, 80.92 feet; thence S 00 053156" W, 6.04
feet; thence S 87 °59139" W along the existing north
right -of -way line of Asher Avenue, said line lying 3C?

Avenue, 125.00 feet to the Point of Beginning; said
tract containing 0.479 acre (2,086 S.F.), more or less;
2 -A -E1:
And also a strip of temporary construction easement,
10 feet in width, lying northerly and easterly
of, adjacent to, and parallel with the tract described
above, for use during street widening only; said strip
of temporary construction easement containing 0.060 acre
(2,620 S.F), more or less.
2 -A -E2:
And also a temporary construction easement, 20
feet in width and 21.5 feet in average length, lying
east of and adjacent to the temporary construction
easement described above, for use during driveway
construction only; said temporary construction easement
containing 0.010 acre (430 S.F.), more or less.
3. A tract of land situated in Lots 2, 3 and 4, Block 161,
John Barrow's Addition to the City of Little Rock,
Pulaski County, Arkansas, being more particularly bound
and described as follows:
Beginning at the southeast corner of said Lot 2; thence
N 88 017109" W along the south line of said Lot 2, 3.62
feet; thence along the proposed west right -of -way line
of John Barrow Road, N 00 049145" E, 49.06 feet and N 12°
52' 12" W, 101.35 feet to the north line of said Lot 4;
thence S 88 018141" E along said north lot line, 27.63
feet; thence S 00 049145" W along the existing
west right -of -way line of John Barrow Road, 147.17 feet
to the Point of Beginning; said tract containing 0.039
acre (1,711 S.F.), more or less;
23 -E:
And also a strip of temporary construction
easement, 10 feet in width, lying west of, adjacent to,
and parallel with the tract described above, for use
during street widening only; said strip of temporary
construction easement containing 0.034 acre (1,495
S.F.), more or less.
SECTION 2. The City of Little Rock hereby declares that the
above described parcels of land are needed for public purpose as
aforesaid and that it desires to acquire fee simple title to said
parcels which are presently owned by Neosha L. Avery, R.J.
Yelenich, and Gail 0. Freeman, respectively; and the City
Attorney is hereby authorized and directed to file in the proper
court proceedings under the City's power of eminent domain for
the condemnation of said parcels and secure orders of said
court permitting the City to take possession of said property and
to do any and all other things necessary in order to obtain
immediate possession of said property.

SECTION 3. This Ordinance shall be in full force and effect
from and after its passage.
