3 AN ORDINANCE AMENDING IN PART SECTIONS 1
4 AND 2 OF ORDINANCE NO. 11,366 TO PROVIDE
5 FOR LEVYING ADDITIONAL PRIVILEGE FEE TO
6 BE PAID BY ARKANSAS LOUISIANA GAS COMPANY
7 FOR THE YEAR 1988; PROVIDING FOR THE
8 PAYMENT THEREOF.

10 WHEREAS, the Arkansas Louisiana Gas Company (hereinafter
11 sometimes referred to as "Gas Company ") is or will be duly
12 authorized by franchise ordinance to operate a gas distribution
13 system and appurtenances thereto, used in or incident to the
14 rendition of gas service to Little Rock, Arkansas and the
15 inhabitants thereof residing in said municipality; and
16 WHEREAS, the Gas Company is now and will be occupying the
17 streets and alleys of this City for the purpose of operating,
18 maintaining, and extending its gas services to the municipality
19 and supplying the municipality and consumers therein gas service;
20 and
21 WHEREAS, the municipality is entitled to receive such just
22 and reasonable fees from the Gas Company which the City may
23 lawfully impose and the Gas Company is entitled to pay.
24 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
25 THE CITY OF LITTLE ROCK, ARKANSAS:
26 SECTION 1. That the sale, furnishing, transmission and
27 distribution of gas and energy by the ARKLA Gas Company in the
28 City is hereby declared to be a special privilege; and that the
29 use of City owned lands and properties is a special privilege; and
30 that for the latter privilege the Gas Company shall pay to the
31 City a special fee, charge or imposition, as follows:
32 For the year 1988, the Gas Company shall pay in
33 equal monthly installments beginning January
34 1988, the sum of Two Million, Three Hundred
35 Fifty Thousand Dollars ($2,350,000.00) or an
36 amount equal to five and two - tenths percent

(5.2 %) of the Gas Company's gross revenues as
paid to it during the calendar year 1988 by
industrial, residential and commercial customers
located within the corporate limits of the City
of Little Rock, whichever is greater. Said gross
revenues shall be certified by an officer of the
Gas Company.
SECTION 2. Payments to the City by Arkansas Louisiana Gas
Company of the amounts as provided for in Section 1 hereof shall
be made monthly payable by the 15th of each month.
SECTION 3. It is acknowledged that Ordinance No. 11,366 as
amended by Ordinance No. 14,982 which set out the terms and
conditions of the present privilege authority under which the Gas
Company is operating is the controlling document over this
franchise.
SECTION 4. All ordinances and parts of ordinances that
conflict herewith are hereby repealed. Provided, however,
Ordinance No. 11,366 of the City of Little Rock is repealed only
to the extent that the same is in direct conflict herewith and
nothing herein shall be construed to alter or change the terms or
conditions of the present franchise under which the Gas Company is
operating.
SECTION 5. This ordinance shall be in effect January 1,
