NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. This Ordinance shall be known and may be cited as the "Passenger Automobile Safety Belt Ordinance.$$ SECTION 2. Each driver and passenger of a motor vehicle operated on a street or highway in the City of Little Rock shall wear a properly adjusted and fastened safety belt as provided for under Federal Motor Vehicle Safety Standard 208. SECTION 3. The driver of a passenger automobile shall secure or cause to be secured in a properly adjusted and fastened safety belt system, any passenger who is at least five (5) years of age, but less than sixteen (16) years of age. SECTION 4. For purposes of this Ordinance, the term "motor vehicle" shall include automobiles as defined by Subsection (A) of Section 24 of Act 65 of the 1929 Acts of Arkansas, as amended. The term "motor vehicle" shall not include vehicles which are used as school buses, church buses or other public conveyance vehicles. SECTION S. Section 2 of this Ordinance shall not apply to the following: (a) A passenger automobile manufactured before July 1, F4:ZS? (b) A passenger or operator of a motor vehicle with a physically or psychologically handicapping condition when the disability would prevent appropriate restraint in such safety belt, provided, however, that such condition is duly certified by a physician who shall state the nature of the handicap, as well as the reason such restraint is inappropriate. p-a6 b•5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 528 (c) Children under five (5) years of age who require protection under Act 749 of 1983 known as the "Child Passenger Protection Act ". (d) A passenger automobile which is not required to be equipped with a safety belt system under federal law. SECTION 6. No person shall be stopped, inspected, or detained solely to determine compliance with this Act. SECTION 7. This Ordinance shall not apply to motorcycles, motorcycle operators or passengers. SECTION S. A violation of this Ordinance shall be punishable by a fine of not more than twenty -five dollars ($25.00). SECTION 9. All monies generated through the imposition of a fine for a violation of this offense shall be used by the City Manager to promote public awareness and education on the usage of safety belts and other related traffic safety matters. SECTION 10. The City Manager's Office and the Little Rock Police Department shall immediately establish a program for disseminating information to the public about the requirements of this Ordinance. SECTION 11. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance, which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
