AN ORDINANCE WAIVING THE REQUIREMENTS OF
COMPETITIVE BIDDING FOR REPAIRS OF A SEWER
LINE SITUATED AT THE LITTLE ROCK MUNICIPAL
AIRPORT: DECLARING AN EMERGENCY, AND FOR
OTHER PURPOSES

o immediate repairs to prevent further deterioration of the line

H and potential related destruction to the surface portion of the
x land in proximity to the runway or appurtenances thereto; and
v WHEREAS, the Sanitary Sewer Committee of Little Rock has

E determined the repairs which are necessary and it is the
,° recommendation of the Little Rock Wastewater Utility staff that

the repairs should be made as promptly and as expeditiously as

H possible without competitive bidding which, in the opinion of
the Little Rock Wastewater Utility staff and the Little Rock
Sanitary Sewer Committee, would serve no useful purpose but, on
the contrary, would delay the expeditious repair to the detri-
ment of the public health and welfare; and
WHEREAS, the Sanitary Sewer Committee of the City of Little
Rock passed a resolution on February 17, 1988, declaring that
repairs were urgently needed on portions of the sewer line on
property occupied by the Little Rock Municipal Airport and it
was not practical or feasible to obtain competitive bids in
order to enter into a contract for the necessary repairs and
that a contract could be negotiated on terms advantageous and
economical for the purpose of making the repairs on this sewer
line as soon as reasonably and economically possible; and
WHEREAS, pursuant to Arkansas Code §14 -58 -303 and City
Ordinance of Little Rock §2 -44, the Board of Directors, by
Ordinance, may waive the requirement of competitive bidding in
exceptional situations where such procedure is not feasible and
the necessity for immediate repair to the sewer line on the
Little Rock Municipal Airport property constitutes such an
exceptional situation because competitive bidding would serve

no useful purpose, but on the contrary would cause further
delay in making the repairs and a greater cost due to delay,
NOW THEREFORE, BE IT ORDAINED by the Board of Directors of
the City of Little Rock, Arkansas:
Section 1. That the condition of the sewer line situated
on the property occupied by the Little Rock Municipal Airport
is in immediate need of repairs and competitive bidding for the
purpose of entering into an agreement with a responsible con-
tractor to perform the repairs would serve no useful purpose,
the Sanitary Sewer Committee and the Manager of the Little Rock
Wastewater Utility are hereby authorized to proceed forthwith
to employ a responsible contractor to perform all repairs in-
cidental to or related to the sewer line and the requirement of
competitive bidding is hereby waived.
Section 2. That since the repairs to the sewer line on the
Little Rock Municipal Airport property are immediately neces-
sary and the authorization extended to the Sanitary Sewer
Committee and the Manager of the Little Rock Wastewater Utility
is of great importance to the health and welfare of the citi-
zens of Little Rock, an emergency is hereby declared to exist
and this Ordinance shall be in full force and effect from and
after its passage and approval.
