HomeMy WebLinkAbout155271 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 '28 29 30 31 32 33 34 35 36 • ORDINANCE NO. 15,527 AN ORDINANCE CALLING A SPECIAL ELECTION IN THE CITY OF LITTLE ROCK, ARKANSAS, TO APPROVE AN ORDINANCE PERMITTING HOTELS, MOTELS AND RESTAURANTS TO SELL ALCOHOLIC BEVERAGES ON SUNDAYS IN ACCORDANCE WITH THE PROVISIONS OF ACT 766 OF 1987; PRESCRIBING OTHER MATTERS RELATING THERETO. f, . WHEREAS, the City of Little Rock, Arkansas, ( "the City ") is a city of the first class that contains restaurants, hotels and convention centers that compete for convention and tourism business; and, WHEREAS, these hotels, motels and restaurants are presently permitted to sell alcoholic beverages with meals from Monday through Saturday; and WHEREAS, Act 766 of 1987, presently codified as Ark. Code Ann. §§ 3 -9 -401 et seg (Supp.1987)( "the Act "), authorizes hotels, motels and restaurants to obtain permits to sell alcoholic beverages on Sundays upon compliance with the terms and provisions of the Act; and WHEREAS, this authorization is conditioned upon approval of the voters of the City; and WHEREAS, it is the desire of the Board of Directors of the City to refer this matter to the voters during the November, 1988, general election, pursuant to the authority granted in Ark. Code Ann. § 3 -9 -215 (Supp. 1987). D-3 ;I A -1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 i8 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 M M NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1: There is hereby called a special election to be held on November 8, 1988, at which election there shall be submitted to the electors of the city, the question of whether the Board should pass an ordinance that would allow hotels, motels and restaurants that possess a permit for on- premises consumption of alcoholic beverages to obtain a permit for on- premises consumption to alcoholic beverages on Sundays from the hours of 12:00 noon to 10:00 p.m. in accordance with Act 766 of 1987, as amended. SECTION 2: The question shall be placed on the ballot for the election in substantially the following form: Vote on the measure by placing an "X" in the square opposite the measure either for or against: F-1 U FOR the Board of Directors passing an ordinance permitting hotels, motels and restaurants with permits for on- premises consumption of alcoholic beverages to sell alcoholic beverages on- premises on Sundays between the hours of 12:00 noon and 10:00 p.m. in accordance with Act 766 of 1987. r_1 LJ AGAINST the Board of Directors passing an ordinance permitting hotels, motels, and restaurants with permits for on- premises consumption of alcoholic beverages to sell alcoholic beverages on- premises on Sundays between the hours of 12:00 noon and 10:00 p.m. in accordance with Act 766 of 1987. 342 M 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 M M M The measure, if approved, will enable the Board of Directors to approve an ordinance that incorporates the terms and conditions of Act 766 of 1987, codified as Ark. Code Ann. § 3 -9 -401 to 412 (Supp.1987). This ordinance will permit restaurants, hotels and motels that possess a permit for the on- premises sale of alcoholic beverages and that meet the requirements of state law to apply for and obtain a permit that would also permit the on- premises sale of alcoholic beverages between the hours of 12:00 noon and 10:00 p.m. on Sundays. SECTION 3. The election shall be held and conducted, and the vote canvassed and the results declared, in the manner now provided for municipal elections so far as that law is applicable, and only qualified voters of the City shall have the right to vote at the election. SECTION 4. The City Clerk is hereby authorized and directed to publish notice of this special election by one publication in a newspaper having general circulation within the City by at least two (2) insertions, the last being not less than 10 days prior to the date of the election. SECTION 5. The results of the election shall be proclaimed by the Mayor, and this proclamation shall be published one time in a newspaper published in the City and having a bona fide circulation therein, which Proclamation shall advise that the results as proclaimed shall be conclusive unless attacked in the Circuit Court of Pulaski County, Arkansas, within thirty (30) days after the date of publication of such Proclamation. SECTION 6. That a copy of this Ordinance shall be given to the Pulaski County Board of Election Commissioners so that the necessary election officials and supplies may be provided. That all ordinances and parts of ordinances thereof in conflict herewith are hereby repealed to the extent of such conflict.
