AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
ENTER INTO ANY NECESSARY CONTRACTS WITH TEXAS
EASTERN TRANSMISSION CORPORATION AND TEXAS
EASTERN PIPELINE CORPORATION FOR THE RELOCATION
OF A 20 INCH PRODUCTS LINE AND A 24 INCH GAS
PIPE LINE FOR THE FOURCHE CREEK PROJECT,
PHASE II; WAIVING COMPETITIVE BIDDING AND
DECLARING AN EMERGENCY.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City Manager is authorized to enter any
necessary contracts with Texas Eastern Transmission Corporation
( "Texas Eastern ") to relocate a 20 inch and a 24 inch pipeline
crossing Fourche Creek as required by the Fourche Creek Drainage
Project. The total expenditure under this contract will not
exceed the sum of two million and one hundred thousand dollars
($2,100,000.00). However, the sum paid shall not exceed the
amount of the lowest responsible bid for the project received by
Texas Eastern, and in no event shall be more than an amount
determined to be just compensation for the City's taking an
interest in the easement presently owned by Texas Eastern and
the associated costs of interfering with this easement.
SECTION 2. Because Texas Eastern has unique experience
in the relocation of gas product and natural gas pipelines, and
easement that are being disturbed by the Fourche Creek Drainage
Project, and because this type of movement requires special
licenses and permits from the federal government, and since
Texas Eastern has agreed to include two Arkansas contractors in
the list of qualified bidders, and since time is of the essence
in the completion of this project due to the necessity to use
these pipeline during the approaching autumn and winter seasons
for the delivery of related gas products to the North and
Northeast portions of the United States, it is impractical and

unfeasible for the City to develop the criteria and to submit to
competitive bidding the costs of relocating the pipelines
covered under this Agreement. Therefore, an emergency is
declared to exist and the contract can be awarded to Texas
Eastern on a timely basis.
SECTION 3. Because time is of the essence on the
completion of this work, and this work must be done to protect
the health, safety and welfare with the citizens by assuring
completion of a flood control project, an emergency is hereby
declared to exist and this ordinance shall be in full force and
effect from the date of its passage.
