ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS, VACATING, ABANDONING, AND CLOSING
THAT PORTION OF WEST 15TH STREET COMPRISING THE RAILROAD
CROSSING LOCATED BETWEEN JONES STREET AND WOODROW STREET
WITHIN WORTHEN AND BROWN'S ADDITION TO LITTLE ROCK,
ARKANSAS.
WHEREAS, a Petition was duly filed with the Board of
Directors of the City of Little Rock, Arkansas, by Missouri
Pacific Railroad Company on the 10th day of March, 1989, asking
the Board of Directors to vacate, abandon and close that portion
of West 15th Street comprising the railroad crossing located bet-
ween Jones Street and Woodrow Street as described below, which
portion of West 15th Street was dedicated to the public by Plat
and Bill of Assurance dated November 21, 1889 and filed for
record in Deed Record Book 28 at Page 210 in the office of the
Recorder of Pulaski County, Arkansas, subject, however, to any
public utility easements therein; and
WHEREAS, after due notice as required by law, the Board of
Directors has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and has
ascertained that the portion of West 15th Street described below
has heretofore been dedicated to the public use as a street; that
the owner of all property abutting upon that portion of West 15th
Street to be vacated, abandoned and closed, namely Petitioner
herein, has filed with the Board of Directors its Petition for
closure thereof and has accordingly consented thereto; that all
property owners abutting upon the remaining portions of West 15th

Street located between Jones Street and Woodrow Street have been
furnished written notice of the Petition and hearing thereon;
that said portion of West 15th Street as described below is no
longer needed or required for corporate purposes; and that the
public interest and welfare will not be adversely affected by the
abandonment of the portion of West 15th Street described below:
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. Except as stated in Section 2 below, the City of
Little Rock, Arkansas, hereby released, vacates and abandons all
its rights, together with the rights of the public generally, in
and to the street designated as follows:
That part of West 15th Street, more par-
ticularly described as follows: Beginning at
the Southeast corner of Lot 11, Block 8,
WORTHEN & BROWN'S ADDITION to the City of
Little Rock, Arkansas; thence run West along
the North line of West 15th Street to the
Southeast corner of Lot 14, Block 9, WORTHEN &
BROWN'S ADDITION; thence in a Southerly direc-
tion to the Northeast corner of Lot 1, Block
10, WORTHEN & BROWN'S ADDITION; THENCE East
along the South line of West 15th Street to
the Northwest corner of Lot 7, Block 11,
WORTHEN & BROWN'S ADDITION; thence in a
Northerly direction to the point of beginning;
Section 2. The City specifically retains the right to use,
and allow others to use, the former street right -of -way in its
entirety as a public utility and drainage easement.
Section 3. Abutting owners of record, receiving title to the
abandoned right -of -way and easement shall at their cost remove
all vestiges of public use and access as may exist; such modifi-
cations shall include, but are not limited to the following:

A. The entrances on both ends of the aban-
donded right -of -way and easement shall
be offset and /or rebuilt to conform to
the standard driveway design as required
by Ordinance No. 12,501.
B. The edge of pavement of the right -of -way
shall be rebuilt to conform to the
existing conditions in the general
vicinity where the abandoned right -of -way
and easement intersects with the
remaining public right -of -way.
Section 4. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the Office of the Recorder of
Pulaski County and recorded in the records of the County.
Section 5. This Ordinance shall take effect and be in force
from and after its passage and approval.
