AN ORDINANCE VACATING AND CLOSING
KELLETT ROAD BETWEEN
FOURCHE DAM PIKE AND RELOCATED FOURCHE DAM PIKE
IN N/A ADDITION TO THE
CITY OF LITTLE ROCK, ARKANSAS

WHEREAS, it has been determined that Kellett Road between Fourche
Dam Pike and Relocated Fourche Dam Pike in Block N/A of N/A Addition to
the City of Little Rock, Arkansas, as designated on the plat of said
Addition now appearing of record in Deed Book N /A, Page N/A in the Office
of the Recorder of Pulaski County, Arkansas, is no longer needed for
corporate purposes, except for public utility and drainage easement
purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
SECTION 1. Except as stated in Section 2 below, the City of Little
Rock, Arkansas, hereby releases, vacates and abandons all its rights,
together with the rights of the public generally, in and to the street
designated as follows:
A tract of land located in the NW 1/4, SE 1/4 and the NE 1/4,
SE 1/4 of Section 8, Township 1 North, Range 11 West, City of
Little Rock, Pulaski County, Arkansas, being more particularly
described as follows:
Commencing at a metal post at the center of said Section
8, T -1 -N, R -11 -W; thence S39 °20104 11W, 190.01 feet to an axle;
thence S88 °35'31 "E, 195.04 feet; thence N39 °21136 "E, 35.51 feet
to the Point of Beginning on the north right -of -way line of
Kellett Road; thence along said north right -of -way line of
Kellett Road the following courses and distances:
S88 035131 "E, 249.69 feet to the intersection of said north
right -of -way line of Kellett Road with the western right -of -way
line of Barzen Road; S88 °35130 "E, 24.26 feet to the
intersection of said north right -of -way line of Kellett Road
with the eastern right -of -way line of Barzen Road; thence
S88 °01137 "E, 201.27 feet; thence N89 °56'01 "E, 89.37 feet;
thence S88 °26155 "E, 126.16 feet; thence S88 °35131 "E, 99.85
feet; and S88 °35131 11E, 486.17 feet; thence S01 °24129 "W, 50.18
feet to the south right -of -way line of Kellett Road; thence
along said south right -of -way line of Kellett Road the
following courses and distances: N88 °35131 "W, 43.72 feet;
N01 048113 "E, 10.49 feet; N88 °35131 "W, 1228.02 feet to the
intersection of the south right -of -way line of Kellett Road
with the east right -of -way line of Fourche Dam Pike; thence
N09 °40148 "W, 40.76 feet to the Point of Beginning and
containing 1.593 acres, more or less.

SECTION 2. The City specifically retains the right to use, and
allow others to use, the former street right -of -way in its entirety as a
public utility and drainage easement.
SECTION 3. Abutting owners of record, receiving title to the
abandoned right -of -way and easement shall at their cost remove all
vestiges of public use and access as may exist; such modifications shall
include, but are not limited to the following:
A. The entrances on both ends of the abandoned right -of -way and
easement shall be offset and /or rebuilt to conform to the
standard driveway design as required by Ordinance No. 12,501.
B. The edge of pavement of the right -of -way shall be rebuilt to
conform to existing conditions in the general vicinity where
the abandoned right -of -way and easement intersects with the
remaining public right -of -way.
SECTION 4. A copy of this Ordinance, duly certified by the City
Clerk, shall be filed in the Office of the Recorder of Pulaski County and
recorded in the records of the County.
SECTION 5. This Ordinance shall take effect and be in force from
and after its passage and approval.
