AN ORDINANCE ESTABLISHING AN INTERIM
OVERLAY DISTRICT FOR THE HIGHWAY 10
CORRIDOR PURSUANT TO THE DESIGN OVERLAY
AUTHORITY OF CHAPTER 36 OF THE CODE OF
ORDINANCES OF THE CITY OF LITTLE ROCK,
ARKANSAS; AND DECLARING AN EMERGENCY.
WHEREAS, the City Board of Directors is committed to the
implementation of the Highway 10 Land Use Plan adopted by the City
on May 20, 1986; and
WHEREAS, the objectives of the adopted Highway 10 Land Use
Plan include: protection of the scenic quality of the highway;
devising land use patterns consistent with the traffic capacity of
Highway 10; creation of a parkway atmosphere along Highway 10 by
substantial building setbacks, extensive landscaping and uniform
tree plantings; minimization of curb cuts along Highway 10 to
maintain a high service level; providing for significant
redevelopment opportunities at key locations; facilitating
transition of areas to more intense uses along Highway 10 without
undesired effects of small lot strip development; and construction
of residential densities not to exceed planned utility capacity
for the area; and
WHEREAS, the City Board of Directors of the City of Little
Rock is interested in establishing Design Overlay Districts for
the City of Little Rock; and
WHEREAS, a Highway Overlay Corridor Zoning Committee was
appointed by the City Board of Directors to explore the
possibilities that might arise through the use of overlay zones in
order to address some of the design problems the City has
encountered on the more intensely developed arterial corridors;
and
WHEREAS, the Highway Overlay Corridor Zoning
concluded that the Highway Corridor Overlay concept

2 WHEREAS, the Highway Corridor Overlay Committee recognized
3 that Highway 10 is the subject of current growth pressures; and
4 WHEREAS, the Highway Corridor Overlay Committee concluded
5 that establishing the complete, detailed, permanent standards of
6 the overlay district will be a long process of study, meetings and
7 hearings to develop the detailed final standards; and
8 WHEREAS, the City Board of Directors is aware of the need
9 expressed by the Overlay Committee, the Planning Commission and
10 the Planning staff to establish interim overlay standards before
11 development advances along Highway 10 in such a way as to negate
12 the purposes of the overlay district; and
13 WHEREAS, a Design Overlay District for Highway 10 is not a
14 substitute for the Highway 10 Land Use Plan; and
15 WHEREAS, a Design Overlay District for Highway 10 is an
16 effort to help make the Highway 10 Land Use Plan effective; and
17 WHEREAS, an interim design overlay ordinance is desirable
18 in order to preserve the existing scenic quality of Highway 10
19 while more detailed standards are developed; and
20 WHEREAS, as a result of the current lack of overlay
21 standards along the Highway 10 corridor and the current rate of
22 development and proposed development along the Highway 10
23 corridor, an emergency exists thereby necessitating interim
24 overlay standards along the Highway 10 corridor.
25 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
26 THE CITY OF LITTLE ROCK, ARKANSAS:
27 SECTION 1. Pursuant to Chapter 36 of the Code of Ordinances
28 of the City of Little Rock, a Scenic Overlay Design District for
29 Highway 10 is hereby established as follows:
30 A. DOD - Highway 10 Scenic Corridor: Purpose and Intent
31 A Highway 10 Scenic Corridor Overlay is hereby established,
32 consistent with the objectives of the Highway 10 Land Use Plan
33 adopted by the City of Little Rock, and pursuant to the authority
34 granted under Chapter 36 of the Code of Ordinances of the City of
35 Little Rock providing overlay zoning districts. The purpose of
36 establishing this district is to protect and enhance the aesthetic

and visual
character of the lands surrounding Highway 10. In

particular
the purposes of this district are as follows:

1.
To protect and enhance the scenic quality of the
4
Highway 10 corridor by providing for sensitive
5
developments which will maximize the natural foliage
6
and terrain while also providing planted buffer and
7
landscaped areas.

2.
To allow land use patterns compatible with present and
10
future traffic capacity for Highway 10.

3.
To create a distinctive parkway atmosphere along
13
Highway 10 by encouraging substantial building
14
setbacks, extensive landscaping and uniform tree
15
plantings.
16

4.
To minimize the number of curb cuts along Highway 10 so
18
that the roadway will function at an efficient level of
19
service.
20
21
5.
To facilitate transition of areas from less to more
22
intense land uses along Highway 10 without the
23
undesired effects of small lot strip development.
24

6.
To create standards for signage and parking lot
26
lighting which are in keeping with the intent of this
27
ordinance.

B.
District Boundaries
29
The
district encompasses all land with Highway 10 frontage
30
lying within 500 feet of each side of the right -of -way of Highway
31
10 from the western boundary of the intersection of Rodney Parham
32
Road and Highway 10 to the eastern boundary of the intersection of
33
Highway 10
and Highway 300.

C.
Application of District Regulations
35
The
regulations in this ordinance shall be in addition to
36
and shall
overlay all other zoning districts and other ordinance

1 requirements regulating the development of land so that any parcel
2 of land lying in the overlay district shall also lie within one or
3 more of the other underlying zoning districts. Therefore, all
4 property within this overlay district will have requirements of
5 both the underlying and overlay zoning district in addition to
6 other ordinance requirements regulating the development of land.
7 In case of conflicting standards between this ordinance and other
8 City of Little Rock ordinances, the overlay requirement shall
9 control.
10 These regulations apply to all development, redevelopment
11 or expansion of existing development with the exception of single
12 family and duplex development under zoning districts R -1, R -2,
13 R -3, and R -4, or PUD submissions as required.
14 D. Site Design and Development Standards
15 1. Lot Size -- There shall be a minimum development
16 tract size of not less than 3 acres.
17 2. Front Yard -- All principal and accessory
1g buildings or structures are required to have a 100
19 foot building setback from the property line
20 abutting Highway 10.
21 3. Rear Yard -- Rear yard shall not be less than 40
22 feet.
23 4. Side Yard -- Side yard shall not be less than 30
24 feet.
25 5. Landscaping Treatment -- Landscaped areas shall
26 attempt to incorporate existing on site trees and
27 shrubbery into the landscaping scheme and the
28 plans shall indicate such incorporation.
29 a. Landscaped areas shall have water sprinkler
30 systems to maintain plant materials.
31 b. Erosion retardant vegetation shall be used on
32 all cuts and fills.
33 c. Tree species to be planted within this
34 corridor should be consistent with other
35 species present.
36 d. The Highway 10 frontage (front yard) shall

consist of a minimum of 40 feet of landscaped
area exclusive of right -of -way. The landscaped
area shall contain a berm which is a minimum
of 3 feet in height, on which trees are
planted no more than every 20 feet and which
are a minimum of 2 inches in diameter when
measured 12 inches from the ground.
Where a developer demonstrates that this
requirement will constitute an undue hardship,
a landscaped area exclusive of right -of -way
may consist of a minimum of 25 feet. In those
instances only, a half -berm shall be
constructed which is a minimum of 3 feet in
height with tree plantings as required herein;
provided however, that this provision may only
be applied to a maximum of 20% of the highway
frontage affected in the plans submitted.
e. Rear and side yards shall have a landscaped
buffer averaging a minimum of 25 feet from the
property line. Where such yards abut a street
right -of -way, a 15 foot landscaped strip shall
be required adjacent to land zoned office and
residential. A 7 foot landscaped strip shall
be required when adjacent to lands zoned
commercial.
6. Signage -- Signage shall comply with the Little
Rock Sign Ordinance, except as follows:
a. Commercial Development Signage -- Signage
identifying the commercial development shall
not exceed 10 feet in height and 100 square
feet in area. All signs that are
ground- mounted shall be of a monument type
design. These signs may be installed in the
landscaped area of the front and side yards.
b. Commercial Building Signage -- Each separate
commercial building will be allowed a single

1 monument ground- mounted sign located on the
2 building site or in the landscaped front yard
3 of the commercial development. The sign shall
4 be a maximum of six (6) feet in height and
5 seventy -two (72) square feet in area.
6 7. Curb Cuts -- Tracts of 700 feet or less frontage
7 on Highway 10 shall be allowed one (1) curb cut.
8 Two (2) curb cuts per tract are allowed along
9 Highway 10 provided the property exceeds 700
10 linear feet of frontage.
11 8. Lighting -- Parking lot lighting shall be designed
12 and located in such manner so as not to disturb
13 the scenic appearance preserved in this corridor.
14 Lighting should be directed to the parking areas
15 and not reflected into the adjacent
16 neighborhoods.
17 9. Building sites - -The maximum number of buildings
18 per commercial development shall be measured both
19 by minimum tract size and minimum frontage as
20 follows:
21 Tract Size /Frontage Number of Buildings
22 3 to 5 acres 1
23 5 -10 acres /330 feet 2
24 10 -15 acres /660 feet 3
25 15 acres or more /990 feet 4
26 E. Commercial Developments and Multiple Building Sites
27 In the case of a commercial development or other
28 development involving multiple building sites, whether on one or
29 more platted lots, the above - described regulations shall apply to
30 the development as an entire tract rather than to each platted
31 lot. Developments of this type shall be reviewed by the City
32 through a site plan review process which illustrates compliance
33 with this ordinance.
34 F. Exceptions
35 Property which cannot be developed without violating the
36 standards of this ordinance shall be reviewed through the Planned

Unit Development (PUD) section of the zoning ordinance, with the
intent to devise a workable development plan which is consistent
with the purpose and intent of the overlay standards.
SECTION 2. The Board of Directors hereby finds and declares
that as a result of the current development pressure along the
Highway 10 corridor, the overwhelming need for overlay standards
along the Highway 10 corridor, and the additional time needed to
develop more detailed standards, that in order to protect and
preserve the health, safety and welfare of the citizens of this
City, an emergency is hereby declared to exist and this ordinance
shall be in effect immediately upon its passage.
SECTION 3. The City Manager is directed to prepare a
report for review within six months of the passage of this
ordinance which shall include a thorough review of the overlay
standards for Highway 10. A permanent ordinance with recommended
changes shall be submitted to the Planning Commission within nine
months.
