AN ORDINANCE VACATING AND CLOSING
HERMITAGE STREET IN MONTCLAIR SUB-
DIVISION OF THE CITY OF LITTLE ROCK,
ARKANSAS

WHEREAS, it has been determined that a portion of
Hermitage Street west of Bowman Road in the Montclair
Subdivision of the City of Little Rock, Arkansas, as
designated on the plat of said Addition now appearing of
record in Deed Book 3, Page 1337 in the Office of the
Recorder of Pulaski County, Arkansas, is no longer needed
for corporate purposes, except for public utility and
drainage easement purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Except as stated in Section 2 below, the
City of Little Rock, Arkansas, hereby releases, vacates and
abandons all its rights, together with the rights of the
public generally, in and to the street designated as
follows:
RIGHT -OF -WAY I
A public right -of -way in the Southwest 1/4 of Section 4,
T -1 -N, R -13 -W, Pulaski County, Arkansas, being more particu-
larly described as :

Starting at the Southwest corner of the Northwest 1/4 of the
Southwest 1/4 of said Section 4; thence North 0 °20'34" East
along the West line of said Northwest 1/4 Southwest 1/4 a
distance of 14.96 feet to the North right -of -way line; thence
South 88 043102" East along said North right -of -way line 703.15
feet to the Point of Beginning; thence continuing South 88 143'
02" East 627.77 feet to the West right -of -way line of Bowman
Road; thence South 0 021'25" West along said West right -of -way
line 45.19 feet to a point on the North line of Tract 11,
Montclair Subdivision to the City of Little Rock; thence
North 88 142'31" West along the North line of said Tract 11 a
distance of 7.74 feet to the centerline of the Southwestern
Bell "Little Rock to Texarkana 'A' Cable" right -of -way; thence
South 46 °11'00" West along said centerline 7.06 feet to a point
on the South right -of -way line; thence North 88 042'31" West
along said South right -of -way line 614.94 feet; thence North
0 019'04" East 50.10 feet to the Point of Beginning containing
0.721 acres, more or less.

A public right -of -way in the Southeast 1/4 of Section 4,
T -1 -N, R -13 -W, Pulaski County Arkansas, being more particu-
larly described as:
Starting at the Southwest corner of the Northwest 1/4 of the
Southwest 1/4 of said Section 4; thence North 0 020'34" East
along the West line of said Northwest 1/4 Southwest 1/4 a
distance of 14.96 feet to the North right -of -way line; thence
South 88 143'02" East along said North right -of -way line 39.97
feet to the Point of Beginning; thence continuing South 88 °43'
02" East along said North right -of -way line 663.18 feet; thence
South 0 119'04" West 50.10 feet to a point on the South right -of-
way line; thence North 88 °42131" West along said South right -of-
way line 662.92 feet; thence North 0 000150" East 50.00 feet to
the Point of Beginning containing 0.762 acres, more or less.
SECTION 2. The City specifically retains the right to
use, and allow others to use, the former street right -of -way
in its entirety as a public utility and drainage easement.
SECTION 3. Abutting owners of record, receiving title
to the abandoned right -of -way and easement shall at their
cost remove all vestiges of public use and access as may
exist; such modifications shall include, but are not limited
to the following:
A. The entrances on both ends of the abandoned right -
of -way and easement shall be offset and /or rebuilt
to conform to the standard driveway design as
required by Ordinance No. 12,501.
B. The edge of pavement of the right -of -way shall be
rebuilt to conform to existing conditions in the
general vicinity where the abandoned right -of -way
and easement intersects with the remaining public
right -of -way.
SECTION 4. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the Office of the Recorder
of Pulaski County and recorded in the records of the County.
SECTION 5. This Ordinance shall take effect and be in
force from and after its passage and approval.
