AN ORDINANCE AWARDING A WRECKER FRANCHISE
IN THE CITY OF LITTLE ROCK.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS:
SECTION 1. The Board of Directors hereby awards a
franchise, attached as Exhibit "A" and made a part hereof, to
Trek Inc. for the operation of wrecker
service in the City of Little Rock.

EXHIBIT "A" 254.
A FRANCHISE FOR THE OPERATION OF WRECKER
SERVICE IN THE CITY OF LITTLE ROCK.
I.
Y
The Franchisee shall provide and maintain towing and storage
facilities and service for those vehicles which the Police
authorities or other City officials, hereafter referred to as
authorized personnel, order removed from the streets and other
public areas and ways of the City of Little Rock, Arkansas.
II.
The Franchisee shall be required to sweep and haul away all
debris, glass and metal parts of the vehicles damaged at the
scene of an accident. The Little Rock Police Department officer
at the scene shall remain there while this is being done to
provide protection and to inspect the area to see that the
Franchisee has performed his services satisfactorily. The
Franchisee and his employees shall follow the instructions of the
Little Rock Police officer.
III.
The Franchisee shall be a single corporation which maintains
service 24 hours per day each day during the term of the
Franchise, holidays not excepted, throughout all the City
including annexed territory and shall respond without undue delay
when called by authorized personnel.
IV.
The Franchisee shall provide a base of operations in a secured
storage area that is accessible to the public, and provide a
location for retrieval of vehicles with provisions to settle all
necessary business transactions at that location. This shall not
include transactions that must be conducted at the Little Rock
Police Department. Vehicles shall be made available by the
Franchisee for retrieval twenty -four hours a day. The base,
storage area and to location for retrieval sel be approved by
the Director of Human and General Services. 255
V.
The Franchisee shall be solely responsible for any damages
resulting from acts of his own negligence, or the negligence of
his agents or employees, in the towing and storage of any -
vehicles. This shall include, but not be limited to, the
condition of the vehicle, accessories, and the contents. The
Franchisee shall, hold the City of Little Rock harmless from
all damage claims or liability arising out of this Franchise.
The Franchisee shall indemnify the City of Little Rock for any
and all claims or liability arising out of, or resulting from
this -4reement
VI.
It is the policy of the City of i;'t'_t 4 ,n. t.h.a.t, the Franchisee
and his employees and agents shall provide the services
authorized in this Franchise courteously. Their dealings with
the public should be carried out with the utmost respect for the
citizens of this City with whom they come in contact.
When the City of Little Rock has an official hold on a vehicle,
the agent or owner shall secure a release from the Little Rock
Police Department of the vehicle. At the time of receiving the
release, the City of Little Rock will provide a list of charges
authorized by the Franchise to each agent or owner. The
Franchisee shall not release such a vehicle until a properly
executed official release from the Little Rock Police Department
shall have been presented to the Franchisee.
When the City of Little Rock has no official hold on the vehicle
in custody of the Franchisee, the Franchisee shall provide a copy
of the list of all charges allowed pursuant to this Franchise
agreement and of the charges made to the agent or owner of the
vehicle in custody. This list shall have a space in which the
agent or owner of the vehicle in custody will be requested to
sign acknowledging that he has read the list. The Franchisee

shall submit mont • forms on both officially"' held" vehicles and

"no official hold" vehicles to the Director of Human and General
Services in Little Rock City Hall. The form shall be approved by
the Director of Human and General Services.
VII.
The release provided by the Little Rock police Department and all
forms provided by the Franchisee to the general public shall
contain the following information:
Any complaints concerning the services provided
should be made to the office of the Director of
Human and General Services, Little Rock City
Hall, 371 -4538.
VIII.
The Franchisee may dispose of all abandoned vehicles in
compliance with all local, state, and federal laws pertaining to
disposition of said vehicles.
IX.
The Franchise shall automatically expire two years from the date
of its adoption, subject to being extended for twenty -four months
from the date at the option of the Little Rock Board of Directors.
If the Franchisee fails to comply with any of the provisions of
this agreement, the Board of Directors of the City of Little Rock
may cancel the Franchise after a hearing on the matter. The
Franchisee and the City of Little Rock may agree to cancel the
Franchise agreement upon written notice sixty days prior to the
effective date of the cancellation.
X.
The Franchisee shall be required to have available
radio controlled equipment of the following specifications and
any additional equipment necessary to provide towing services:
2 - 8 ton rated wreckers.
3 - 4 ton rated wreckers or larger.
The equipment shall be specified to be either owned or leased by
the Franchisee and evidence shall be provided that the equipment
is available and on call at all times.

The Franchisee sh *l have available a 16 tonaLted wrecker. This 257
equipment shall be either owned, leased or under contract by the
Franchisee.
The equipment shall be in compliance with all applicable state,
federal and local laws. All radios and wrecker equipment are
subject to annual and spot inspections at any time by the
Department of Human and General Services.
Proof of equipment ownership and /or copies of equipment lease or
contract agreements shall be provided at the time of awarding the
Franchise.
XI.
This Franchise provides for the removal of vehicles from public
and private areas as follows:
Vehicles To Be Officially Held.
The Franchisee shall follow the terms and conditions of the
Franchise.
Vehicles Hauled But Not officially Held.
By virtue of this Franchise, vehicles are towed or serviced by
the Franchisee by mere fact of the owner of the vehicle not
having indicated a preference as to what wrecker service to use
and /or the vehicles needed to be towed.
Junk Vehicles.
Vehicles that are unable to be moved from private or public
property and ordered by the City to be moved by the Franchisee
shall be handled as officially held vehicles.
Charges.
The following shall be fees allowed to be charged for services.
No charges for services beyond those specified are allowed. If
services are performed for which no charges are provided, such
shall be considered the cost of doing business in the public
sector.

2. STORAGE
a. $5.00 per 24 hours or any part
thereof on all vehicles, except tractor-
trailers. (1st 24 hours free)

thereof on tractor - trailers. (1st 24. hours free)
XII.
The Franchisee shall file with the Director of Human and General
Services proof of a Certificate of Liability Insurance issued by
a solvent incorporated insurance company licensed to do business
in the state of Arkansas. Said policy must be for the following
amounts, $100,000.00 for the injury or death of any one (1)
person and subject to that limit for each person; $300,000.00 for
more than one person killed or injured in any one accident; and
for damage to property $100,000.00 for each accident. The
Franchisee is also required to have a "Garage Keepers Liability"
policy in the amount of $100,000.00 minimum.
XIII.
This Franchise shall not be sold, assigned, transferred, leased,
or mortgaged without the consent of the Little Rock Board of
Directors.
XIV.
The Franchisee shall pay an annual Franchise Fee of $1,000.00
upon the awarding of the Franchise.

,ISCUSSION: It is recommended that the low bid
submitted by Manson Wrecker be ac=
cepted. Their bid is considered to
be the best based not only on price
but also on an inspection process
conducted by Jerry Paul, Purchasing
Agent, Nat Hill, Director. of Human
and General Services, Harold Hughes,
Vehicle Maintenance Superintendent
and Walter E. Simpson, Chief of
Police. The ratings were based on a
perfect score of 100 were as follows;
Manson Wrecker 87.33
Trek 84.67
Asher Wrecker 82.00
T.J.'s Wrecker 72.00
It is also requested that if Manson -
Wrecker for any justifiable reason
defaults on this contract that the
award be given to Trek, the next
highest rated contractor.
