HomeMy WebLinkAbout14685ORDINANCE NO. 14,685 AN ORDINANCE RECLASSIFYING PROPERTY IN MARKHAM PINES ADDITION; AMENDING THE MAP SHOWN AS PART OF SECTION 43 OF THE CODE OF ORDINANCES; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That the owner's application for reclassifica- tion of the following described real property, to -wit: Z- 4066 -A- Part of the S 1/4 NW 1/4, Section 4, T -1 -N, R -13 -W, Pulaski County, Arkansas, and more particularly described as: Beginning at the NW corner of Lot 171, Markham Pines Addition; thence North along the East R/W line of Alamo Drive, 171.9' to the South R/W line of West Markham Street; thence East along said South R/W 120.11; thence south 171.3'; thence West 120.0' to the point of beginning, containing 0.47 acres. (S.E. corner Markham & Alamo) from a zoning classification of R -2 to a zoning classification of C -1, as per the current Little Rock Zoning Ordinance, shall be and hereby is granted; provided, however, that portion of the above described lands which is situated within the floodway of Rock Creek -- as shown by the Floodway Boundary and Floodway Maps promulgated by the Federal Emergency Management Agency (F.E.M.A.) and which maps were adopted by Little Rock Ordinance No. 13,797; the maps being on file with the Clerk for the City of Little Rock and designated as Community Panel No. 0501810005C, Panel 5 of 18, dated March 4, 1980 -- shall remain as zoning classification R -2. Section 2. The Little Rock Board of Directors acknowledges that the City of Little Rock currently has a petition before F.E.M.A. requesting a change in the floodway boundaries as shown on the aforesaid current F.E.M.A. maps; and that the said floodway boundary as it is situated upon the above described real property may change. It is the intent of the Little Rock Board of Directors and this Ordinance to reclassify to a C -1 zoning only that portion of the above described lands which is situated outside the floodway of Rock Creek, as it is designated by the aforesaid F.E.M.A. maps. 223 D•S ,r 13 r� r r� ■r ■r r r� r r r �r r r r 224 Section 3. It is further the intent of the Little Rock Board of Directors that, in the event the floodway boundary of Rock Creek -- as it is designated by F.E.M.A. and as it is situated on the above described lands -- is changed, the C -1 zoning reclassification of the described lands shall be amended by Ordinance to reflect the floodway boundary change. That portion of the said lands situated outside the F.E.M.A. floodway boundary shall remain or be reclassified to a C -1 zoning, and that portion of the described lands encompassed within the floodway shall remain or be reclassified R -2 zoning. Provided, the administrative level hearings may be avoided and the appropriate proposed amendatory ordinance placed directly on the agenda for consideration of the Board of Directors. Section 4. The map which is referred to in Section 43 of the Code of Ordinances of the City of Little Rock and the designated district map shall be and it is hereby amended to the extent and in the respects necessary to effect and designate the change in zoning or classification provided for in Section 1 above.
