PASSED: December 7, 1982 ATTEST: CiVy Clerk APPROVED: - Mayor W City Hall Markham at Broadway Little Rack, Arkansas 72201 371 -4527 E M 0 R A N D TO: MAHLON MARTIN SUSAN FLEMING —JANE CZECH JIM LAWSON FROM: R. JACK MAGRUDER III CITY ATTORNEY RE: BILLBOARD ORDINANCE DATE: January 17, 1983 Jane reflects the attached ordinance, labeled Exhibit 1 as the one which was adopted by the Board. Actually, this ordinance was only distributed in Pony Express as a Proposed draft. Prior to the meeting, the wording was changed I wrote it out and Mary Lynn typed it during the invocation. The Board was given copies. The version which was before the Board at the time they voted is Exhibit II.. I am sorry that Ms. Czech did not get a copy of the final version, but what is now reflected as Ordinance No. 14,363 is legally inaccurate. Can we please correct the record. D: Charles Bussey Mayor t 'S i M E M O R A N D U M TO: Jane Czech, City Clerk FROM: R. Jack Magruder, City Attorney January 18, 1983 This will serve as your legal authority to remove Ordinance No. 14,363, passed December 7, 1982, from your records which contains the following section: "Section 1. Section 4.07(d) of Ordinance No. 14,254 is hereby amended to read: (d) Be at least one thousand (1,000) feet apart. The distance between such structures shall be measured along the nearest edge of the pavement between points directly opposite the signs, and each side of the highway will be considered separately." The above version was not the one the Board of Directors actually adopted. This will also serve as your legal authority to place corrected Ordinance No. 14,363, in your official records, containing the following section: "Section 1. Section 4.07(d) of Ordinance No. 14,254 is hereby amended to read: (d) Be at least one thousand (1,000) feet apart. The distance between such structures shall be measured along the nearest edge of the pavement between points directly opposite the signs; provided that on streets, which are separated by a median and, only on those streets, each side of the street shall be considered separately for distance purposes." The above version was the section legally adopted by the Board of Directors.
