AN ORDINANCE AUTHORIZING THE CITY MANAGER
TO AWARD A CONTRACT FOR QUALITY CONTROL
TESTING OF ASPHALTIC CONCRETE MIX FOR THE
ANNUAL STREET RESURFACING PROJECT, AND
DISPENSING WITH NORMAL BIDDING PROCEDURES
TO ALLOW COMMENCEMENT OF RESURFACING TO
AVOID UNDUE DELAY IN THE INTEREST OF THE
PUBLIC PEACE, HEALTH AND SAFETY.
Whereas, it is necessary to make preparation for the annual
resurfacing of the streets of the City; and,
Whereas, administrative difficulties have caused delays in
such preparation; and,
Whereas, insufficient time remains, before beginning the
resurfacing work on schedule, to advertise formally for bids to
test for resurfacing material quality; and,
Whereas, price quotations for such testing have been
received by the Purchasing Division of the Department of Finance
and Administration and considered by the Public Works Department;
and,
Whereas, it has been determined that only one testing
laboratory in this area has the expertise, personnel, and
facilities requisite to assure the quality of service needed
within the cost range affordable by the City, namely McClelland
Engineers, Inc., Little Rock, Arkansas;
Now, therefore:
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS:
Section 1. The City Manager is hereby authorized to award

a contract to McClelland Engineers, Inc., to perform all tests on
the asphaltic concrete mix to be used in the 1983 city street
resurfacing project for a price of 264 per ton not be exceed
budget payable from the Street Fund.

Section 2. It has been found and is declared by the Board
of Directors that there is insufficient time remaining before
beginning the annual street resurfacing work in the City to
advertise formally for bids for testing of resurfacing material
quality; that deferring the commencement of the street
resurfacing to accomodate normal bidding procedure would
seriously delay the resurfacing to the detriment and endangerment
of the public. Therefore, an emergency is declared to exist, and
this ordinance, being necessary for the public peace, health, and
safety, shall take effect and be in force from the date of its
approval.
