HomeMy WebLinkAbout14553ORDINANCE NO. 14,553 AN ORDINANCE TO REINSTATE THE PROVISIONS OF ORDINANCE NO. 14,036 ERRONEOUSLY REPEALED BY ORDINANCE NO. 14,517 SECTION 7; DECLARING AN EMERGENCY. WHEREAS, Ordinance No. 14,036, through error, was repealed by Ordinance No. 14,517 Section 7; and, WHEREAS, it is necessary to reinstate the provisions of Ordinance No. 14,036; and, WHEREAS, it is necessary that such provisions be given retroactive as well as prospective effect in order to validate any and all action taken by the City of Little Rock in reliance on such provisions, Now, therefore: BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The map component of the Master Street Plan adopted September 4, 1979, by Ordinance No. 13,719, is amended to provide for reduction in the area of jurisdiction. The described planning jurisdiction line provided for within Ordinance No. 13,996, shall be graphically illustrated on the said map component. Section 2. The map component identified as A -1 of the Master Parks Plan adopted September 20, 1971, by Ordinance No. 12,545 is amended to provide for reduction in the area of jurisdiction. The described planning jurisdiction line provided for within Ordinance No. 13,996 shall be noted for reference on Map A -1. The notation shall include, but shall not be limited to, such information as necessary to identify the adopting ordinance, the date of passage and authority. There are certain park sites within the present planning jurisdiction which, by the above action, will be omitted from the ordinance text and map. Section 3. The provisions hereof shall apply retroactively to and including the effective date of Ordinance No. 14,517 so as to validate any and all action, otherwise valid, taken in A reliance on Ordinance No. 14,036, as well as prospectively from the effective date hereof. Section 4. It has been found and is declared that the erroneous listing of Ordinance No. 14,036 in the repealing clause of Ordinance No. 14,517 poses a serious threat to the orderly administration of the planning laws and regulations relative to streets and parks, that there is urgent need to correct this condition, and that this measure will provide the remedy. Therefore, an emergency is declared to exist and this ordinance, being necessary for the preservation of the public peace, health, and safety, shall take effect and be in force from the date of its approval.
