AN ORDINANCE AMENDING CHAPTER 43, SECTION
7- 105.4(h)(2) OF THE LITTLE ROCK CODE OF
ORDINANCES; TO ESTABLISH SETBACKS FOR
STRUCTURES IN THE FLOODPLAIN.

o Section 1. Chapter 43, Section 7- 105.4(h)(2)
.0 of the Code of Ordinances of the City of Little Rock,

Arkansas, is hereby amended to read as follows:

"(2) Proposed structures: Any structure
—I proposed within a Floodplain District shall comply with
the following criteria:
a. Structures located in the Downtown
area, Coleman Creek, Jimerson Creek,
Walton Heights, Grassy Flat Creek,
Fourche Creek Bottoms, Fourche Island,
Fish Creek, and Lorance Creek Watersheds
shall have the lowest floor (including
basement) elevated or floodproofed a
minimum of one foot above the one -
hundred -year flood level.
b. Residential structures located in
the Rock Creek, Brodie Creek, McHenry
Creek, Callagahan, Haw Branch, Otter
Creek, Crooked Creek, Upper Fourche
Creek, Little Fourche Creek, Flether
Creek, Little Maumelle River, and
Taylor Loop Creek Watersheds shall
have the lowest floor (including
basement) elevated or floodproofed
a minimum of three feet above the
one - hundred -year flood level.
Conmiercial and industrial structures
in these watersheds shall have the
lowest floor (including basement)
elevated or floodproofed a minimum
of two feet above the one- hundred-
year flood level.
C. No structure shall be closer than
twenty -five feet to any established
floodway line.
d. Uses having a low flood- danger
potential shall be permitted within
the twenty -five (25) foot setback
to the extent that they are not
prohibited by ordinance and provided
they do not require structural
involvement. Examples of such uses
include loading areas, parking area,
open storage of materials or equipment,
and public and private recreational
uses.

e. Where it can be demonstrated that
acceptable alternative means of
access to the floodway can be
provided and that the existing or
proposed structure will not be
subjected to erosion or structural
damage, or for other good and
sufficient reasons, the Planning
Commission may modify or eliminate
the required setback.
f. Floodways shall be kept free of
structural involvement including
fences, open storage of material
and equipment, vehicle parking and
other impediments to the free flow
of floodwater. Exceptions may be
granted when existing topography
is at or above the existing 100
year flood level and when the
velocity of flow is less than three
(3) feet per second.
g. Cantilever construction over the
floodway may be allowed when the
lowest structural elevation of
the cantilever section is greater
than five (5) feet above the 500
year flood level. Pilings and
columns are expressly prohibited.
