HomeMy WebLinkAbout14301ORDINANCE NO. 14.301 370 AN ORDINANCE ASSESSING THE VALUE OF BENEFITS TO BE RECEIVED BY THE OWNERS OF EACH OF THE SEVERAL BLOCKS, LOTS AND PARCELS OF LAND WITHIN LITTLE ROCK MUNICIPAL IMPROVEMENT DISTRICT NO. 138. WHEREAS, a majority in value of the property holders owning property adjoining the locality to be affected and situated in Little Rock Municipal Improvement District No. 138, organized for the purposes of (i) constructing within the District a sanitary sewer collection system to serve the inhabitants of said District and constructing a sanitary sewer line beyond the boundaries of said Sewer District, if necessary, to make the desired connection with the sanitary sewer system of Little Rock, Arkansas, (ii) opening, grading, draining and paving (including curbs and gutters) a street called East Port Drive and providing access thereto from Fourche Dam Pike, (iii) constructing a water pipeline distribution system and connecting the same with the system of Little Rock and (iv) installing a 4 inch gas main and connecting the same to the Arkansas - Louisiana Gas distribution system, have requested the Board of Directors of the City of Little Rock, Arkansas, for the construction initially of that part of the foregoing improvements consisting of widening Fourche Dam Pike at the entrance to East Port Drive and constructing said entrance, extending a 12 inch water main under the pavement to connect with the Little Rock system, and constructing the sewer outfall line and that the cost thereof shall be assessed upon the real property of said District according to the benefits received; and WHEREAS, the benefits received from said construction by each and every block, lot and parcel of real property situated in said District equal or exceed the local assessment thereof; and 371. WHEREAS, the estimated cost of said improvement is Ninety Thousand Dollars ($90,000.00); NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the several blocks, lots and parcels of real property situated in Little Rock Municipal Improvement District No. 138, be assessed according to the assessment list for said Improvement District as the same now is on file in the office of the City Clerk and that the assessment of benefits on each of said blocks, lots and parcels shall be collected by the Pulaski County Collector in successive annual installments of four percentum (4%) each, with the first annual installment to be collected on February 15, 1983. SECTION 2. The second and subsequent annual installments, each in the amount aforesaid, shall be paid with the first installment of general taxes becoming due on the third Monday in February of each calendar year beginning in 1984 until the whole of said assessment of benefits shall be paid; provided, however, such annual payments may, at the option of the taxpayer, be paid in installments along with the installments of the ad valorem taxes. SECTION 3. The collection of the annual installment may be suspended in whole or in part for any year upon the filing by the Commissioners of the District, with the County Collector by December 1 of the preceding year, of a certificate reciting the amount of funds available to meet debt service requirements of the bonds of the District and, if necessary to provide additional funds therefor, certifying the percentage of the next annual installment on the amount of benefits necessary to be collected. -2- i 372 SECTION 4.
