ORDINANCE NO. 14,210
AN ORDINANCE ACCEPTING THE RECOMMENDATION OF THE
LITTLE ROCK PLANNING COMMISSION, ESTABLISHING THE
MASTER STREET PLAN OF THE LITTLE ROCK PLANNING
AREA, AND RELATED MATTERS, ESTABLISHING SAID PLAN,
REPEALING ORDINANCE NO. 13,719; AND FOR OTHER
PURPOSES.

WHEREAS, Act 186 of the 1957 General Assembly of the State
of Arkansas authorizes cities to prepare and adopt master street
plans; and
WHEREAS, the City of Little Rock is in need of an
up -to -date, comprehensive plan for adoption as a statement of
intent concerning the growth and function of its street and
highway pattern, as a framework and guide in further planning and
engineering studies, and as a means of securing for the City and
its citizens the benefits of an official plan; and
WHEREAS, the Little Rock Planning Commission has submitted
to the Board of Directors a report of recommendations, in the
form of the resolution hereinafter referred to, respecting the
establishment of the Master Street Plan of the Little Rock
Planning Area, and

SECTION 2. The design considerations of the functionally
classified street system of the City of Little Rock shall be as
follows:
A. Residential and Minor Residential Streets:
The primary function of a residential or local street
is the provision of access to adjacent property, and
the secondary function is the movement of traffic.
This functional hierarchy plainly discourages through
traffic. Buses and heavy trucks should be excluded
when the abutting land use is residential. Other uses
of local streets are as easements for utilities and as
open space to provide air and light.

The primary and secondary functions of a collector
street are the opposite of the functions of a
residential street. The primary function of a collector
is to conduct traffic from residential streets to
arterials or to activity centers. The secondary
function is the provision of access'to abutting
property. The collector street system should not form
a continuous system, but should direct traffic to
arterials. This will discourage traffic from using the
collectors as arterials. The spacing of the collector
system is dependent upon the density of residential
neighborhoods, the use of mass transportation, and the
location of community shopping centers and other large
traffic generators.

The primary function of both principal and minor
arterials is the provision of movement of a large
volume of traffic with the major difference in the two
being in the amount of traffic carried. Although
direct access to abutting land cannot be prohibited,
the number of access points should decrease as the
volume increases. When there is a high volume of
traffic and the adjacent land is intensively developed,
points of conflict become very high and movement is
restricted correspondingly. The arterial is designed

and also to major traffic generators, such as regional
shopping centers or large industrial parks.

D. Freeway and Expressways
These two route systems serve the major centers of
activity of the metropolitan area. These systems
provide the highest traffic volume corridors and the
longest trips. The freeways in Little Rock are con-
structed with fully controlled access, and the majority
are also part of the Interstate Highway System. The
expressway system has full or partial access control,
but is not part of the interstate system. Design
considerations for these two systems are not provided as
these would be determined by the Arkansas Highway and
Transportation Department, provided, however, that
freeways and expressways which are not funded with
federal monies shall be designed and constructed by the
City of Little Rock.

SECTION 4. Intersection The Planning Commission may
require additional right -of -way at the intersection of Arterial
and Collector Streets. An intersection will be considered on its
own merits at time of submission to the Commission. The
intersection right -of -way requirement shall generally not exceed
120' for a depth of 250 feet from the point of intersection of
right -of -way lines. In cases of planned large -scale development,
deceleration and acceleration lanes and additional dedication may
be required at the discretion of the Planning Commission.
SECTION 5. Additional R -O -W Additional right -of -way will
be required by the Planning Commission when it is apparent that
grade problems, horizontal curve problems, intersections, and
similar conditions require greater right -of -ways to permit
construction. The Commission also may require additional
right -of -way and additional pavement width adjacent to large
residential, commercial and industrial traffic generators where
it is deemed necessary to provide the necessary capacity to
service the traffic generator.

SECTION 6. Setbacks upon submission of a building permit,
the Master Street Plan shall be consulted. If the proposed
structure is adjacent to a facility noted and described on said
plan, proper setback shall be provided. The setback as required
will be measured from the centerline of the established
right -of -way except in those areas where the street as
constructed deviates from the established right -of -way line, in
which case the setback will be measured from the centerline of
the existing pavement.
The required setbacks for the various classifications are as
follows:

Authority, Jurisdiction Anforcement. 199
A. Any subdivider of land within the planning area of the
Little Rock Planning Commission who proposes to make or
have made a subdivision of land shall conform to this
plan by indicating on any plats or drawings submitted
to said Commission for its consideration, any street
identified in this plan which traverses or abuts the
said property.
Where the said property abuts a street included in the
Master Street Plan, the property owner shall dedicate
no more than one half of the required right -of -way as
established in the Master Street Plan. In the event
that the proposed centerline of the right -of -way does
not coincide with the existing property lines resulting
in a disproportionate amount of right -of -way required
from one property owner, the City of Little Rock will
reserve for acquisition any right -of -way in excess of
one half of the total right -of -way which the property
owner is required to vacate.
Where the said property is traversed by the street, the
property owner will be required to dedicate the entire
amount of right -of -way as established in the Master
Street Plan.
Such acquisition must be made within twelve (12) months
from the date the final plat is filed for record with
the Office of the Pulaski County Circuit Clerk.
Further acquisition shall be deemed as having been made
when either an option to purchase is executed or suit
to condemn is filed by the City of Little Rock;
provided, however, no subdivider shall be denied the
privilege of having a plat approved solely by reason of
the issue of reserved right -of -way unless the City
determines and advises said subdivider within sixty
(60) days from the date his plat is presented to the
Little Rock Planning Commission that public funds for
acquisition will be available within twelve (12) months
from the date plat is presented.
Where an expressway, principal arterial or minor
arterial intersects an existing or proposed expressway,
principal arterial or minor arterial and where an
expressway or principal arterial intersects a collector
street, the subdivider shall dedicate an additional 10
feet of right -of -way, measured from the centerline of
the right -of -way, for a right turn lane. This
additional right -of -way shall normally be 250 feet in
length measured from the centerline of the intersecting
right -of -way. At such intersections, the intersecting
right -of -way lines shall normally have a radius of 75
to 100 feet.
B. Whenever the Little Rock Planning Commission is
presented with a request for consideration of a plat
involving any facility shown or described in the Master
Street Plan, the Commission will determine the exact
location and extent of right -of -way necessary for the
provisions of said facility, and shall require, in
conjunction with the approval.of the preliminary plat,
the dedication or reservation of the right -of -way as
stipulated, and shall recommend for consideration by
the Board a proposal to alter the location by amendment
to this plan.
C. In all cases wherein subdivision and development or
resubdivision and development of land is involved, no
building permit shall be issued for the construction of
any new building, or for an addition to an existing
building, or for the moving of any building, on any lot
or parcel of land which is traversed by or abuts any

indicated street facility unless it has first been
determined that the proposed structure would not lie
within the proposed bounds of said facility.
D. In all situations other than where land is being
subdivided and developed, no lot or parcel of land
which lies within the right -of -way of a proposed street
shall be privately developed or shall any permit be
issued authorizing such until the-City of Little Rock
shall have refused to execute a written option or to
file suit for condemnation to acquire said area. Such
refusal shall be given by the City of Little Rock
within one year of the date such action is requested by
the property owner; provided, however, no property
owner shall be denied the privilege of developing such
lot or parcel of land by reasons of the provisions of
this ordinance unless the City determines and advises
such property owner within sixty (.60) days from the
date of request for action that public funds for the
acquisition will be available within twelve (12) months
from the date of request for such action by said
property owner.
E. No provision of this ordinance shall be construed to
deny a permit for the remodeling, repair or maintenance
of an existing building not involving structural
alteration or for the use of said lot or parcel for
purposes not involving the construction or relocation
of buildings.
F. The Master Street Plan of the Little Rock Planning Area
shall be duly considered prior to action on any matter
related thereto which comes before the Little Rock
Planning Commission, this Board or any of the
departments, agencies, boards or commissions of this
City.
The Planning Commission may determine the location of
additional collector streets which are not included within the
Master Street Plan, but which are considered necessary for the
continued-development of an efficient and complete circulation
system.
SECTION 9. If conflicts between this ordinance and other
City ordinances should occur, the most restrictive ordinance
shall prevail.
SECTION 10. This Ordinance has been reviewed and approved by
the Pulaski Area Transportation Study and the City Engineer of
the City of Little Rock.
SECTION 11. Repealing Clause. Ordinance No. 13,719 and
parts of other ordinances in conflict herewith are hereby
repealed.
SECTION 12. Recording. A copy of this ordinance, together
with the maps and charts referred to herein, shall be filed in
the Office of the Recorder of Pulaski County as required by Act
186 of 1957 of the General Assembly of the State of Arkansas.

SECTION 13. Severability. If any section, clause,
paragraph, provision, or portion of this ordinance or plan shall
be held invalid or unconstitutional, such holding shall not
affect any other section, clause, paragraph, provision or portion
of this ordinance or plan.
