A RESOLUTION AUTHORIZING THE
EXTENSION OF THE LEASE FOR
AMUSEMENT RIDES AND CONCESSIONS AT
WAR MEMORIAL PARR FOR A PERIOD OF
ONE YEAR; AND FOR OTHER PURPOSES.

WHEREAS, the present amusement concession lease with Lloyd
L. Choate expired November 2, 1990; and
WHEREAS, in view of lessee's record in maintaining the area
and his commitment to continue to do so, the staff has
recommended that this lease be extended until November 2, 1991;
and
WHEREAS, the Board of Directors consents to a one year
extension of said lease pursuant to the last paragraph of the
lease dated November 19, 1980, and
WHEREAS, lessee has agreed to an amendment to move certain
amusement rides as directed by the Parks and Recreation
Department in order that the fitness complex can be completed as
designed.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The extension of the lease with Lloyd Choate for
amusement rides at War Memorial Park is hereby authorized for a
period of one year ending November 2, 1991, with an amendment
that he will move certain amusement rides as directed by the
Parks and Recreation Department.
SECTION 2. This resolution shall be in full force and
effect from and after its adoption and approval.

AMENDMENT TO AMENDED LEASE DATED NOVEMBER 19, 1980,
(AS SUBSEQUENTLY AMENDED BY AMENDED LEASE DATED
NOVEMBER 9, 1983), BETWEEN THE CITY OF LITTLE ROCK,
ARKANSAS, LESSOR, AND LLOYD CHOATE, LESSEE,
PERTAINING TO AMUSEMENT RIDES AND CONCESSIONS AT
WAR MEMORIAL PARK IN LITTLE ROCK, ARKANSAS
This amendment to amended lease dated November 19, 1980,
(as subsequently amended by amended lease dated November 9,
1983), between the City of Little Rock, Arkansas, a municipal
corporation organized and existing under Arkansas law, lessor,
and Lloyd Choate, Lessee, is made and entered into at Little
Rock, Arkansas this 5th day of December , 1990.
W I T N E S S E T H:
WHEREAS, the City of Little Rock, Arkansas, as Lessor, and
Doyle O'Kelley, Lessee, entered into an amended lease dated
November 19, 1980, for a term ending November 2, 1990, involving
land situated in war Memorial Park in said City pertaining to
the operation of amusement rides and concessions in said park;
and
WHEREAS, the last paragraph of the lease dated November 19,
1980, provides that the Lessor must consent in writing to any
renewal or extension of said lease; and
WHEREAS, said lease was assigned by Lessee (with the
approval of Lessor) to Lloyd Choate on October 14, 1982; and
WHEREAS, it is determined to be mutually advantageous to
the Lessor and Lessee that said amended lease be extended for
for a period of one year, to November 2, 1991; and
WHEREAS, Little Rock Resolution No. 8,409 adopted by the
Board of Directors of the City on 12_4_90 , authorizes an
extension for one year, until November 2, 1991.

NOW, THEREFORE, for mutual valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, Lessor
and Lessee covenant and agree as follows:
I.
The amended lease dated November 19, 1980, and a subsequent
amendment dated November 9, 1983, are hereby incorporated by
reference herein.
II.
Lessee agrees that he will move such amusement rides as
directed by the Parks and Recreation Department upon reasonable
notice in order that the fitness complex can be completed as
designed. Lessor agrees to give Lessee ten (10) days notice in
advance of such move date.
III.
This agreement is for a term of one year, and shall expire
November 2, 1991.
IV.
This agreement
may
be
executed in
any number
of
counterparts, each of
which
when
so executed
and delivered
shall
be an original, but all of which together shall constitute one
and the same agreement.
